JAKARTA - The National Police Reform Acceleration Commission proposes that matters related to the assignment of members of the National Police in ministries/institutions be regulated by the Omnibus Law mechanism.
"We just agreed to use the Omnibus method, both in the drafting of the law and also the drafting of the Government Regulation (PP). For example, if there is a link to the Environmental Law, the Law on the TNI, the Law on Forestry, then we will consider the verses or articles that are related to the police," said Chairman of the Commission for the Acceleration of Polri Reform, Jimly Asshiddiqie in a press conference in South Jakarta, quoted by Antara.
This was proposed following the issuance of the Regulation of the National Police of the Republic of Indonesia (Polri) Number 10 of 2025 concerning Police Officers who Carry Out Tasks Outside the Structure of the Police Organization after the Constitutional Court (MK) Decision Number 114/PUU-XXIII/2025.
Jimly said that one of the PPs that must be discussed is the implementation of the ASN Law.
"The PP in carrying out the ASN Law, which has not been drafted since 2023, has been more than two years in the previous government era," he said.
He also said that one of the complaints received by his party was related to the assignment of members of the National Police across agencies.
According to the commission, the resolution of the complaint is to raise it to a higher level so that it is not only binding internally for the police, but also for related agencies.
"We hope that there will be cross-ministerial coordination under the coordination of the Coordinating Minister for Human Development and Culture, Mr. Imipas, Mr. Otto (Deputy Coordinating Minister for Human Development and Culture Imipas) will prepare everything where the National Police Reform Acceleration Commission will provide input in the inter-ministerial coordination meeting," he said.
On the same occasion, member of the National Police Reform Acceleration Commission and Deputy Minister of Home Affairs Imipas Otto Hasibuan said that there needed to be a mutual agreement regarding the positions that the members of the National Police could occupy.
"So, we have to discuss together what can be held, what can not be. This should not be in a certain policy, but the inter-agency must talk," he said.
"Earlier, Professor Jimly talked about, could this be initiated by the Ministry of Law and Human Rights Imipas to coordinate all related institutions to discuss this so that it is possible whether a PP needs to be issued immediately to address this issue," continued Jimly.
It is known that the National Police Chief, General Pol. Listyo Sigit Prabowo, signed Police Regulation Number 10 of 2025 which regulates that members of the National Police can occupy positions outside the police structure, especially in 17 ministries/institutions, such as the Coordinating Ministry for Political and Security Affairs, the Ministry of Energy and Mineral Resources, the Ministry of Law, the Ministry of Immigration and Corrections, the Ministry of Forestry, the Ministry of Maritime Affairs and Fisheries, the Ministry of Transportation, the Ministry of Protection of Indonesian Migrant Workers, and the Ministry of Agrarian and Spatial Planning/National Land Agency.
Then, members of the National Police, as regulated in the Perpol, can also occupy positions in the National Resilience Agency, Financial Services Authority, Financial Transaction Reporting and Analysis Center, National Narcotics Agency, National Counterterrorism Agency, National Intelligence Agency, National Cyber Security Agency, and the Corruption Eradication Commission (KPK).
