JAKARTA - The South Jakarta District Court (PN) rejected the preliminary trial filed for the second time by the President Commissioner of PT Dosni Roha Logistik (DNRL) Bambang Rudijanto Tanoesoedibjo or Rudy Tanoe.

This legal effort was carried out after he was named a suspect in the alleged corruption of the distribution of rice social assistance for the hope family program (PKH) by the Corruption Eradication Commission (KPK).

"To judge, one, to reject the applicant's request for all of them," said Single Judge of the South Jakarta PN Lukman Ahmad, Monday, December 15.

"Second, impose a legal fee on the Applicant of zero," he continued.

The judge said that the KPK as the petitioner had the authority to handle the alleged corruption case allegedly committed by Rudy Tanoe. The process that is running is also in accordance with the applicable procedures and mechanisms.

Regarding the alleged acts and the alleged article against Rudy Tanoe, the judge stated that it had entered into the main material that must be proven in the Corruption Crime Court (Tipikor).

"And no longer subject to pretrial examination," said the judge.

Meanwhile, the KPK appreciated the decision made by the South Jakarta PN. KPK spokesman Budi Prasetyo explained that the judge was right.

"In its consideration of Article 14, even though other laws do not mention the act of tipikor, it does not mean that the KPK is not authorized to handle it, because in Article 14 which must be interpreted is the phrase every person who violates the provisions of the act as a tipikor," said Budi through his written statement.

"Then regarding the evidence for the determination of the suspect, considering it has been tested and assessed in the previous pretrial, the judge will not test it again," he continued.

Budi also explained that the authority related to the calculation of state losses had also been tested in the first pretrial hearing filed by the media entrepreneur's brother, Hary Tanoesoedibjo.

"As for the applicant's position as a commissioner, it is not included in the object of the application because it must be proven in the main case," explained Budi.

"The KPK expresses its appreciation for the pretrial decision which tests the formal aspects in the alleged corruption case related to the distribution of rice social assistance for beneficiary families (KPM) in the 2020 fiscal year Family Hope Program (PKH)."

As previously reported, the KPK has again investigated alleged corruption at the Ministry of Social Affairs (Kemensos). A preliminary investigation order (sprindik) has been issued and the case is related to the distribution of social assistance (bansos).

The investigation has been underway since August this year and is an expansion of an earlier corruption case.

Three people have been named as suspects in this case, they are B. Rudijanto Tanoesoedibjo as President Commissioner of PT Dosni Roha Logistik; Edy Suharto as former Director General of Social Empowerment of the Ministry of Social Affairs and now serving as a specialist staff of the Minister of Social Affairs in the field of Social Change and Dynamics and Kanisius Jerry Tengker who is the President Director of PT Dosni Roha Logistik in 2020-2022.

Then, the KPK also named two corporate suspects, namely PT Dosni Roha Indonesia and PT Dosni Roha Logistik. However, the official announcement of the suspects has not been made.
