MBG SPPG Negligence Can Be Criminal Law

JAKARTA Trisakti University criminal law expert, Abdul Fickar Hadjar assessed, managers of the public kitchen for the Free Nutrition Food (MBG) program or the Nutrition Fulfillment Service Unit (SPPG) can be charged with criminal law if they are proven negligent and cause mass poisoning.

"Anyone who causes pain or death can be prosecuted criminally, including the kitchen and food provider MBG," he said, Sunday, September 28, 2025.

He considered that the legal process must continue to be carried out to ensnare the parties responsible for the poisoning. This is in accordance with the provisions of Article 360 of the Criminal Code which states, first, whoever because of his mistake (equality / negligence) causes other people to be seriously injured, is threatened with a maximum imprisonment of 5 years, or a maximum imprisonment of a year.

Second, whoever because of his mistake (his negligence / negligence) causes other people to be injured in such a way that a disease or obstacle to carrying out work, position, or search for a certain time is threatened with imprisonment for a maximum of nine months or imprisonment for a maximum of six months, or a maximum fine of four thousand five hundred rupiah.

"In addition to the crime, MBG managers can also be sued on a civil basis to pay compensation to victims," added Fickar.

He stated that legal responsibility is not only attached to MBG provider institutions or corporations, but also to individuals who are directly involved. Fickar emphasized that complete legal handling can provide a deterrent effect, even though it depends on the individual concerned.

"The complete handling of the law is certainly not only for corporations providing MBG, but also for people who are directly involved. The point is that whoever is guilty must be punished," he said.
