Deputy Minister of Law (Wamenkum) Eddy Hiariej urged the revision of the Criminal Procedure Code (KUHAP) to be completed in 2025.

He warned that if the revision was not completed, the impact could be fatal, including the potential for all detainees to be released because there was no legal basis.

"This is indeed as much as possible to be completed in 2025, because the Criminal Procedure Code will take effect on January 2, 2026," said Eddy Hiariej at a working committee meeting (Panja) with the Legislation Body (Baleg) of the DPR at the Parliament Complex, Senayan, Jakarta, Thursday 18 September.

He stressed that the deadline is crucial because the old Criminal Code will not take effect from 2026. So, the revision of the Criminal Procedure Code which will regulate the latest criminal procedural law mechanism must be ready immediately.

Eddy reminded that the legal danger is if the revision of the Criminal Procedure Code has not been ratified until 2026. According to him, law enforcement officers will lose their legal basis for detaining suspects.

"Because they were detained based on the objective requirements of detention in the Criminal Procedure Code in Article 21 paragraph 4. Even though it refers to the old Criminal Code," he said.

"Starting January 2, 2026, the Criminal Code has not been in effect for a long time. So law enforcement officials will lose legitimacy to make forced efforts," he added.

Seeing this urgency, Eddy firmly urged the DPR, especially Baleg, to accelerate the legislative process.

"We really ask that this revision of the Criminal Procedure Code can be completed this year, so that next year it can be used directly in conjunction with the enactment of a new Criminal Code," he concluded.
