People's Palm Oil Corruption, Aceh Prosecutor's Office Confiscates IDR 17 Billion, Detains Former DPRK Members And Officials

Aceh High Prosecutor's Office (Kejati) investigators have detained three suspects in the alleged corruption of the people's palm oil rejuvenation program (PSR) in Aceh Jaya Regency with state losses reaching Rp38.4 billion. In addition to detention, investigators also confiscated more than Rp17 billion in cash as evidence.

Assistant for Special Crimes at the Aceh Attorney General's Office, M Ali Akbar, said the three suspects were detained at the Class IIB Banda Aceh Detention Center after an examination was carried out on Wednesday, August 13.

"The reasons for the detention include preventing the disappearance of evidence, repeating actions, and intervening witnesses because the suspects are still serving in the Aceh Jaya Regency Government," said Ali Akbar in Banda Aceh, quoted from Antara.

The three suspects are S, Chairman of the Sama Mangat Agriculture Cooperative who is also a member of the Aceh Jaya DPRK for the period 2024-2024; TM, former Head of the Aceh Jaya Agriculture Service in 2017-2020 as well as Acting Head of Service in 2023-2024; and TR, Head of the Aceh Jaya Agriculture Service in 2021-2023 who is now the Regional Secretary of Aceh Jaya.

This case began when S submitted a proposal for the rejuvenation of people's palm oil for 599 planters with a land area of 1,536.7 hectares to the Palm Oil Plantation Fund Management Agency (BPDPKS) through the Aceh Jaya Agriculture Service.

The administrative and technical verification carried out by the agency resulted in technical recommendations, so BPDPKS distributed more than IDR 38.4 billion to the cooperative.

However, the results of the investigation showed that the proposed land did not belong to the planter, but the land of the former PT Tiga Mitra under the land management rights (HPL) of the Indonesian Ministry of Transmigration.

Satellite imagery also shows that there are no palm oil plants on the land, but forest areas and shrubs.

"The state loss reached Rp38.4 billion and was totally lost because no oil palm rejuvenation was made," said Ali Akbar.

Ketiga tersangka disangkakan melanggar Pasal 2 ayat (1) juncto Pasal 18 UU Nomor 31 Tahun 1999 sebagaimana diubah dengan UU Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi juncto Pasal 55 ayat (1) ke-1 KUHP, serta Pasal 3 juncto Pasal 18 UU Tipikor juncto Pasal 55 ayat (1) ke-1 KUHP.

The three suspects are suspected of violating Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code, and Article 3 in conjunction with Article 18 of the Anti-Corruption Law in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
