YOGYAKARTA Recently, the public has been shocked by the rules of abandoned land for two years that have been confiscated by the state. So, what do the provisions say?

Previously, Minister of Agrarian Affairs and Spatial Planning/Keoala of the National Defense Agency (ATR/BPN) Nusron Wahid said that the government could take over certified land that was not used for two consecutive years. The status of the land will be categorized as abandoned land.

This statement was conveyed by Nusron at the Inauguration and Working Meeting of PB IKA-PMII for the 2025-2030 period at the Bidakara Hotel, Jakarta, Sunday, July 13, 2025.

"The policy is for those who have been mapped and certified when since he was certified, in two years there has been no economic activity or development activity or in the sense that the land is not used for its benefit, the government is obliged to provide a warning letter," said Nusron, quoted by VOI, Wednesday, July 17, 2025.

He added that the warning process to land owners would be carried out in stages. Initially, the government would send an initial notification, then a first, second, and third warning letter.

If within a total period of 587 days since the first letter there is no change, the land will be categorized as abandoned land. The land will then be distributed by the central government as an object of land reform or agrarian reform.

The rules of abandoned land for two years were confiscated by the state as stated in Government Regulation (PP) Number 20 of 2021 concerning Control of Abandoned Areas and Lands.

In Article 7 paragraph (2) of the regulation states that the takeover of abandoned land can be carried out on land of property rights, building rights (HGB), rights of use (HGU), rights of use, rights of management, and land obtained based on the basis of land control.

The land of property rights is the object of controlling abandoned land if it is deliberately, not used, and/or not maintained so that:

Meanwhile, land rights to the management of customary law communities and land rights to management that become land bank assets are exempt from the object of controlling abandoned land.

According to the Head of the Presidential Communication Office (PCO) Hasan Nasbi, the takeover of abandoned land was not carried out unilaterally.

He emphasized that this provision is stated in Government Regulation Number 20 of 2021 concerning Control of Abandoned Areas and Lands which has been in effect since February 2021.

Hasan Nasbi said that there was a mechanism that was carried out before the takeover of abandoned land, namely through a three-time warning waiting period until finally decisive steps were taken. This policy is implemented to avoid agrarian conflicts.
