At The UMMI Rizieq Shihab Hospital Swab Test Session, Expert Witnesses Call There Are Elements Of Lies

JAKARTA - Criminal Law Sociologist from Trisakti University, Trubus Rahardiansyah, said there was an element of lies in the case of the swab test results of the UMMI Hospital in Bogor.

This statement was conveyed by Trubus during the trial when presented as an expert by the public prosecutor (JPU).

At first, the prosecutor asked a question that described a problem. Where, there is someone who is sick but tells others that the person is in good health.

"I am sick, I know what my illness is. Then I tell people, publishing to people I am not sick, I am in good health. Why should I be asked? Because there are factors that cause I announce it. Is it against the norm or is it part of hoax or manipulating facts? " asked the prosecutor during a trial at the East Jakarta District Court, Wednesday, May 5.

Then, Trubus called it a lie. The reason is, the person does not convey the facts.

"If that means conveying information that is not in accordance with facts. Because it is not in accordance with the facts, then, he could have been fabricated or covered up or hidden. If that happens then it is a lie," said Trubus.

In fact, with that lie there will be a violation of the law. Moreover, there are parties who feel cheated.

"If lying has become a violation of the law, his cool language results in law. So then there is a speech that must be accepted," he said.

In the case of the UMMI Hospital swab test, Rizieq Shihab was accused of having spread fake news or hoaxes that caused confusion about his health condition that was exposed to Covid-19 while at the Bogor UMMI Hospital.

Habib Rizieq in the case was charged with Article 14 paragraph (1), paragraph (2), Article 15 of Law Number 1 of 1946 concerning Criminal Law Regulations and / or Article 14 paragraph (1), paragraph (2) of the RI Law Number 4 of 1984 concerning Communicable Disease Outbreaks and / or Article 216 of the Criminal Code in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
