Rorotan Land Corruption, Former Director Of Perumda Sarana Jaya Sentenced To 4 Years In Prison

JAKARTA - Director of Perumda Pembangunan Sarana Jaya (PPSJ) for the 2019 period Indra Sukmono Arharrys was sentenced to 4 years in prison for being proven guilty of corruption related to land acquisition cases in Rorotan, North Jakarta, in the PPSJ environment in 2019-2021.

Chief Judge Rios Rahmanto stated that Indra was also sentenced to a fine of Rp. 300 million, provided that if the fine was not paid, it would be replaced (subsider) with imprisonment for 4 months.

"Declaring that the defendant is proven legally and convincingly guilty of committing a criminal act of corruption together, as stipulated in Article 2 paragraph (1) of the Corruption Act in conjunction with Article 55 paragraph (1) 1st of the Criminal Code, as stated in the first indictment," said the presiding judge in the trial. read the verdict at the Jakarta Corruption Court (Tipikor), Wednesday, confiscated by Antara.

The presiding judge said that Indra's corruption was proven together with the President Director of PT Totalindo Eka Persada (TEP) Tbk Donald Sihombing, Commissioner of PT TEP Saut Irianto Rajagukguk, and Independent Director of PT TEP Eko Wardoyo, so that the three were found guilty according to the same article as Indra.

For the fourth corruption, the Panel of Judges stated that the state suffered a loss of Rp93.86 billion. Losses occurred because acts of corruption were proven to have been carried out to enrich Donald by Rp11.99 billion, Saut and Eko Rp2.4 billion each, and PT TEP by Rp80.8 billion.

Thus, Donald was sentenced to 6 years in prison, a fine of Rp. 300 million, subsidiary to 4 months in prison, and an additional penalty in the form of payment of compensation of Rp. 11.99 billion, subsidiary to 3 years in prison.

Meanwhile, Saut and Eko were each sentenced to 5 years and 4 years in prison, a fine of Rp. 300 million, subsidiary to 4 months in prison, and were charged with compensation of Rp. 2.4 billion.

In imposing the verdict, the Panel of Judges considered several aggravating and mitigating things. This is burdensome, namely the four defendants did not assist the government's program which is currently active in eradicating corruption.

On the other hand, mitigating factors that were considered before passing the verdict were that the defendants were polite at the trial and had family responsibilities.

"Based on the aggravating and mitigating factors that exist in the defendants, the Assembly is of the opinion that the punishment or punishment imposed on the defendants may have fulfilled the sense of justice towards the defendants and the community," said the presiding judge.

The verdict is slightly lower than the demands of the public prosecutor. Previously, Indra was charged with imprisonment for 5 years and 6 months and a fine of Rp. 300 million, subsidiary to 6 months in prison.

Then, Donald was sentenced to 8 years in prison, a fine of Rp. 300 million, subsidiary to 6 months in prison, and compensation of Rp. 208.1 billion, subsidiary to 5 years in prison.

Meanwhile, Saut and Eko were each sentenced to 6 years in prison, a fine of Rp. 300 million, subsidiary to 6 months in prison, and compensation of Rp. 2.4 billion, subsidiary to 3 years in prison.

In that case, the four defendants initially allegedly caused losses to state finances worth Rp224.69 billion related to the alleged corruption case in land acquisition in Rorotan, North Jakarta, in the PPSJ environment in 2019-2021. Corruption was allegedly carried out to enrich Donald amounting to Rp221.69 billion and PPSJ President Director Yoory Corneles worth Rp3 billion.

The case began around December 2018, after the signing of the Sale and Purchase Binding Agreement (PPJB) between PPSJ and PT Adonara Propertindo Pulogebang land, East Jakarta, Yoory was summoned to face the office of former Regional Secretary of DKI Jakarta Province Saefullah.

During the meeting, Saefullah (died on September 16, 2020 due to COVID-19) asked PPSJ not only to buy land in the East Jakarta area because at that time PPSJ had purchased land in Pondok Kelapa, Cilangkap, and Pulogebang.

For this reason, Yoory was asked to buy land in North Jakarta, namely in the Rorotan area, because the price was still cheap. However, in the purchase of the land, there were irregularities, including mark-ups on land prices and land sales that had not completely switched ownership rights.
