Juniver Girsang Proposes The Criminal Procedure Code To Regulate No Direct Liputan During Trial

JAKARTA - Advocates and legal practitioners of Juniver Girsang proposed that the revision of the Criminal Procedure Code (KUHAP) or the Criminal Procedure Code regulate the absence of direct coverage during the trial. He considered that direct coverage could influence the testimony of witnesses.

This was conveyed by Juniver in a public hearing (RDPU) with Commission III of the DPR with the agenda of receiving input on the revision of the Criminal Procedure Code at the Parliament Complex, Senayan, Jakarta, Monday, March 24.

According to Juniver, Article 253 Paragraph 3 of the Criminal Procedure Code requires confirmation regarding court publications.

In the draft of the Criminal Procedure Code Article 253 Paragraph 3 it reads:

'Everyone in the courtroom is prohibited from publicizing the trial process directly without a court permit'.

"This must be clear, so that doesn't mean that the advocate after the trial is not allowed to provide information outside, we can read this Paragraph 3 right; "Everyone in the courtroom is prohibited from publicizing the trial process directly without a court permit," said Juniver.

"So it must be firm, everyone in the courtroom is prohibited from publishing, what is it? Direct coverage," he continued.

The General Chairperson of the National Leadership Council of the Indonesian Advocates Association Suara Advocate Indonesia (DPN Peradi SAI) explained that the reason for the rule that there is no direct coverage from the RKUHAP must be approved. According to him, this should not affect witness statements.

"Why should we agree with this? Because people in criminal trials in direct coverage, witnesses can hear, can influence each other, can cheat, we agree with that," he explained.

"It could be allowed by the judge, of course there are considerations," added Juniver.
