JAKARTA - Secretary-General of the PDI-P (PDIP), Hasto Kristiyanto, said that investigators from the Corruption Eradication Commission (KPK) carried out a 5M operation against people around him in handling cases of alleged interim replacement bribery (PAW) members of the DPR and the obstruction of investigations.
The 5M operation in question is to disguise, deceive, intimidate, seize, and check without a summons.
"The investigation process carried out by the KPK against me and the witnesses clearly violated human rights. KPK investigators carried out 5M operations: disguised, lied, intimidated, confiscated, and examined without a summons. This is a serious violation of fair legal principles," said Hasto when reading the exception at the trial at the Jakarta Corruption Court, Friday, March 21.
The 5M operation, said Hasto, was carried out by investigators, namely Rossa Purbo Bekti, against Kusnadi who is a staff of the PDI-P DPP.
The form is by making an examination schedule for his appointment on June 10, 2024. However, this is only an alibi whose real purpose is to confiscate Kusnadi's belongings.
"However, my examination was only a cover. The real goal was to forcibly seize Kusnadi's belongings which were carried out unlawfully," said Hasto.
"KPK investigators disguised themselves, lied to them, and intimidated Kusnadi. Kusnadi's belongings and the Party's DPP, including cell phones and party meeting notebooks, were confiscated without a valid summons," he continued.
The 5M operation also violated the principle of respect for human rights as regulated in the KPK Law number 19 of 2019. Then, Article 28D paragraph (1) of the 1945 Constitution (UUD) which guarantees the right of every citizen to obtain fair treatment in law.
"Kusnadi was intimidated and examined for almost three hours without a summons. The confiscated items were then used as evidence in the indictment. This is evidence obtained against the law," he said.
In his exception, Hasto assessed that the 5M operation carried out by investigators was not only detrimental to Kusnadi, but also damaged the integrity of the law enforcement process. Therefore, Hasto asked the panel of judges to reject the evidence obtained through the 5M operation.
