Despite Receiving It, PAN Still Questions The Constitutional Court's Decision On PSU In Serang

JAKARTA - The National Mandate Party (PAN) respects the decision of the Constitutional Court regarding the dispute over the 2024 Serang Regency Election which ordered a re-voting (PSU).

"PAN respects the decision of the Constitutional Court regarding the 2024 Serang Regency Pilkada. It is part of PAN's commitment to always support democracy and law enforcement in the joints of national life," said Deputy Chairperson of the PAN DPP Saleh Partaonan Daulay in a statement received in Jakarta, Antara, Tuesday, February 25.

Even so, said Saleh, PAN considered that there were many questionable things regarding the decision of the Constitutional Court (MK).

Because the decision does not meet the requirements to be called a structured, systematic, and massive violation (TSM).

"Try reading the election law again. What TSM means in the law, does not occur in the Serang Pilkada," he explained.

In addition, he continued, the applicants also did not have strong evidence to support his lawsuit.

"The witnesses and organizers who were presented at the trial clearly said that the regional elections in Serang Regency had been carried out in accordance with the provisions of the law," he said.

Saleh stated that in the end PAN accepted the Constitutional Court's decision on the basis of awareness and obedience to the law. While PAN will also mobilize the existing team to win the pair Ratu Rachmatuzakiyah-M. Najib Hamas.

"The team that was formed yesterday is still there and is still active. Everything is just waiting for directions from the leadership and the party. Once mobilized, everything will work hard and be even more enthusiastic," he said.

Saleh continued, "We are sure that the community will side with the Queen-Najib pair. In fact, it could be that support will get bigger. People are now smart and wise. Understand which ones really want to fight and sacrifice for the community."

PAN hopes that if during the re-voting (PSU) the 2024 Serang Regency Pilkada is finally carried out and the pair Ratu Rachmatuzakiyah-M. Najib Hamas wins the election again, there will be no more disputed lawsuits filed.

"However, we still pray, if we win later, we will not be sued again. We are a party that is ready to fight fairly and fairly. We have proven that yesterday in the last Serang Pilkada," he said.

Previously, the Constitutional Court ordered the Serang Regency KPU, Banten, to re-vote (PSU) for the 2024 Pilkada because the argument for the village head's neutrality was proven at trial.

The Constitutional Court ordered the implementation of the PSU within 60 days from the time the decision was pronounced based on the same voter list as the vote on November 27, 2024.

"Granted the petitioner's petition for part," said Chief Justice of the Constitutional Court Suhartoyo reading the Decision Number 70/PHPU.BUP-XXIII/2025 which was requested by candidate pair number 1 Andika Hazrumy-Nanang Supriatna at Building I MK, Jakarta, Monday (24/2).

Constitutional Justice Enny Nurbaningsih explained that the Constitutional Court found the fact that there was a video related to the incident of providing support by a number of village heads to candidate pair number 2 Ratu Rachmatuzakiyah-M. Najib Hamas.

The Constitutional Court also found that there were a series of legal evidences and facts regarding activities involving the Minister of Villages and Development of Disadvantaged Regions Yandri Susanto in the activity of providing support. Yandri is the husband of Ratu Rachmatuzakiyah.
