Anwar Usman Did Not Participate In The Constitutional Court's Decision On Bobby Nasution's Victory Lawsuit In Pigub, North Sumatra

Constitutional Justice Anwar Usman did not participate in deciding the 2024 North Sumatra Regional Election dispute case proposed by the Candidate Pair for Governor and Deputy Governor of North Sumatra Number 2 Edy Rahmayadi and Hasan Basri Sagala.

Based on observations, Anwar Usman left the courtroom when the interim decision (dismissal) for the Eddy-Hasan case was pronounced in the Court Building I Session Room, Jakarta, Tuesday, February 4. Anwar Usman's seat looks empty.

"It is a little necessary to explain to all parties that in this case, Constitutional Justice Anwar Usman used the right of denial not to participate in the decision and also to say (decisions)," said Chief Justice of the Constitutional Court Suhartoyo in the trial of the pronunciation of the 2024 Pilkada dispute decision/decision, Tuesday, February 4, which was confiscated by Antara.

Anwar Usman, said Suhartoyo, used his denial right to avoid potential conflicts of interest. The reason is, one of the participants in the 2024 North Sumatra Pilkada has a family relationship with Anwar Usman, namely the candidate for governor number 1 Muhammad Bobby Afif Nasution.

"According to Constitutional Justice Anwar Usman, this has nothing to do with the ethical decisions that have been experienced, but this is solely because the volunteers (volunteers) are out of their own will, because they feel that one of the candidate pairs for governor is that there is still a family relationship," said the Chief Justice of the Constitutional Court.

In case Number 247/PHPU.GUB-XXIII/2025, Edy-Hasan among them argued that the Candidate Pair for Governor and Deputy Governor of North Sumatra Number 1 Bobby Afif Nasution and Surya committed violations in a structured, systematic and massive manner (TSM).

According to Edy-Hasan, the Bobby-Surya pair was indirectly supported by the Acting Governor of North Sumatra Agus Fatoni. This is allegedly because Agus Fatoni is said to be actively involved in Bobby Nasution who is also the Mayor of Medan in safari activities.

Agus Fatoni is said to often involve Bobby Nasution traveling to a number of districts/cities in North Sumatra which are wrapped with da'wah safaris and safety prayers to knit ukhuwah in interpreting the spirit of PON XXI Aceh-North Sumatra 2024.

In addition, according to Edy-Hasan, Acting Governor of North Sumatra also posted a photo of Bobby Nasution on billboards of every activity that had nothing to do with a series of events.

The Edy-Hasan camp also highlighted the football tournament of the Civil Service Corps of the Republic of Indonesia (Korpri) which was held by the Regional Secretary (Sekda) of North Sumatra. The tournament was contesting the Bobby Nasution Cup as an advisor to the Medan City Korpri.

Furthermore, Edy-Hasan questioned the low participation of voters in a number of districts/cities due to floods, such as in Medan City, Deli Serdang Regency, Binjai City, Langkat Regency, and Asahan Regency.

Based on this argument, Edy-Hasan, among others, asked the Constitutional Court to cancel the results of the 2024 North Sumatra Pilkada, disqualify candidate pair number 1 Bobby-Surya, or order the KPU to re-vote at all polling stations in flood-affected districts/cities.
