Mahfud MD Encourages Minister To Dismantle Tangerang Sea Fence Case: Don't Cover Up For The Sake Of Luxury Institution

TANGERANG Former Coordinating Minister for Political, Legal and Security Affairs (Menkopolhukam) Mahfud MD appealed to ministers whose agencies were related to the fence case in Tangerang Regency waters to reveal it thoroughly.

"Ministers whose ministries are involved in granting permits and Marine Cultivation Rights (HGU) do not need to be afraid. Criminally responsible are intellectual actors, perpetrators, and participants who have the intention of violating the law," Mahfud said through his personal X account, @MohmahfudMD, Tuesday, January 28.

According to Mahfud, the parties responsible for the issuance of Building Use Rights Certificates (SHGB) and Certificates of Ownership (SHM) in the waters are lower officials who receive delegations of authority.

Therefore, he asked the relevant ministers not to hesitate to uncover the case in order to reveal the facts clearly.

"The ones who are criminally responsible are subordinate officials who receive delegations of authority. So, if you feel you are not involved, just dismantle it, Mr. Minister. Many cases were punished, only the director General or employees of his subordinates immediately colluded," he said.

Mahfud also emphasized the importance of submitting evidence to law enforcement officials and not covering up this case in order to maintain the good name of the institution.

"Submit evidence of violations to law enforcement officials. There is no need to cover up cases for the sake of institutional dignity," he added.

Mahfud MD also encouraged law enforcement officials to process criminal allegations related to the issuance of SHGB and SHM in the sea area of Tangerang Regency. He considered that the cancellation of the certificate was not enough.

The illegal HGB certificate for the sea is not enough to be canceled, but must be processed criminally because it is a collusion product that violates the law. The Constitutional Court's decision No. 3/PUU-VIII/2010 and Law no. 1 of 2014 clearly prohibits coastal water exploitation by the private sector and individuals. This is different from the reclamation case," he said.

Mahfud saw indications of malicious conspiracy, collusion and corruption in the case of sea fencing in Tangerang. He asked law enforcement officials to act immediately not only to dismantle the sea fence but also thoroughly investigate the case.

"Seagaring cases must be immediately declared as criminal acts, not just dismantling fences. Immediately carry out investigations and investigations. There are elements of natural grabbing, issuance of illegal certificates, as well as allegations of collusion and corruption," he concluded.
