Land Dispute Case Dago Elos, Bandung District Court Sentenced Muller Brothers 3.5 Years In Prison

The Bandung District Court (PN) sentenced two defendants, namely Herry Hermawan Muller and Dodi Rustandi Muller with a sentence of 3.5 years in prison for falsifying letters and deed documents in the Dago Elos land dispute case, Bandung City.

"Therefore, each of the defendants will be sentenced to 3 years and 5 months in prison," said Chief Justice Syarif when reading the verdict at the Bandung District Court as reported by ANTARA, Monday, October 14.

The two defendants were considered valid and convincing in committing a criminal act using an authentic deed containing false information.

In their consideration, the panel of judges also considered aggravating and mitigating factors. The aggravating thing is that the actions of the two defendants have harmed others.

"The aggravating thing is that the actions of the defendants are detrimental to other people. The mitigating thing is that the defendants have not been convicted and the defendants are polite," said Syarif.

The panel of judges said that the process of issuing birth certificates by adding the name Muller had never been determined from the district court, including the Bandung Regency Population and Civil Registration Service (Disdukcapil) without Muller's name on the names of each defendant.

The panel of judges continued that the defendants were charged with the fourth alternative indictment submitted by the public prosecutor (JPU).

With this decision, the panel of judges said the verdict would affect the Dago Elos land dispute lawsuit case which was won by the two defendants in 2017.

The verdict of the panel of judges was lower than the demands of the public prosecutor who previously demanded that the defendant be sentenced to 5.6 years in prison.
