Rizieq Shihab Accused Of Ignoring Pandemic Conditions When Gathering In Megamendung, Making Dozens Of People With COVID-19

JAKARTA - Rizieq Shihab was charged with not complying with the implementation of health quarantine during the COVID-19 pandemic.

Rizieq Shihab continued to participate in the groundbreaking ceremony for the construction of the Markaz Syariah Agro-Cultural Islamic Boarding School in Kuta Village, Megamendung District, Bogor Regency.

"(The defendant) did not comply with the health quarantine administration as referred to in Article 9 paragraph (1) and / or obstructed the implementation of the Health Quarantine so that it was a public health emergency," said the prosecutor reading out the dakwan at the East Jakarta District Court, Friday, March 19.

In the indictment, Rizieq Shihab's offense first arrived in Indonesia on November 10, 2020. Rizieq Shihab, who had just arrived in Indonesia from Saudi Arabia, was supposed to undergo independent quarantine for 14 days.

However, Rizieq Shihab did not do it. Two days after arriving in Indonesia, Rizieq Shihab actually attended the groundbreaking ceremony for the construction of the Markaz Syariah Agro-cultural Islamic Boarding School.

The Bogor Regency Government, through Satpol PP, who already knew about the existence of this activity, appealed to the surrounding community not to get involved. The district government put up an appeal banner.

However, Rizieq Shihab ignored the appeal. Without obtaining a permit from the Bogor Regency COVID-19 Task Force the event was held

"On Friday, November 13, 2020, the defendant still scheduled to attend to carry out the groundbreaking activity," said the prosecutor.

After the event, the Regional Secretary of Bogor Regency and the Daily Chair of the COVID-19 Task Force, Burhanudin, conducted a rapid test on the people around the boarding school on November 19.

As a result, on November 23, the number of people in Bogor Regency who were exposed to COVID-19 was recorded at 41 people and increased to 71 people on November 30.

"So it has hindered the efforts of the Bogor Regency Regional Government in efforts to monitor and overcome the spread of COVID-19 with a target that was originally in the orange zone (moderate risk) to be restored to a green zone (not affected) or at least remain in the orange zone "But what happened was the opposite, namely increasing to the red zone (high risk). Thus, the Bogor Regency Government must extend the status of PSBB," said the prosecutor.

In this case, Rizieq Shihab was charged with violating Article 93 of Law Number 6 of 2018 concerning Health Quarantine in conjunction with Article 14 paragraph (1) of Law Number 4 of 1984 concerning Outbreaks of Infectious Diseases in conjunction with Article 216 paragraph (1) of the Criminal Code.
