4 Controversy Hasyim Asy'ari: Accommodation Of Constitutional Court Decisions To Sexual Harassment

YOGYAKARTA Hasyim Asy'ari had some dark notes before being dismissed from his position as Chairman of the General Elections Commission (KPU) on Wednesday, July 3, 2024. So, what are Hasyim Asy'ari's controversies?

Previously, the Honorary Council of Election Organizers (DKPP)entuated the Chairman of the Indonesian KPU Hasyim Asy'ari from his position because he was proven to have committed immoral acts against one of the members of the 2024 Election Overseas Election Committee (PPLN).

"Imposing a permanent dismissal sanction to the defendant Hasyim Asy'ari as the chairman considers that the KPU commissioners have been read out since this decision was read out," said DKPP Chairman Heddy Lugito when reading the verdict, quoted by VOI.

In its decision, DKPP also asked President Joko Widodo to carry out the decision no later than 7 days after the verdict was read.

Before being proven guilty of immoral acts, Hasyim Asy'ari was recorded as having committed several controversial actions that attracted public attention. The following are some of the Hasyim Asy'ari controversies that have been summarized by VOI.

1. Process Gibran's registration as a vice presidential candidate without changing the PKPU

After the Constitutional Court (MK) decided to change the age requirements for Presidential Election Participants, Hasyim took action that caused controversy. He processed the registration of Gibran Rakabuming Raka as a vice presidential candidate.

Whereas at that time, the KPU had not changed the minimum age requirements for presidential and vice-presidential candidates in KPU Regulation (PKPU Number 19 of 20223 according to the Constitutional Court's decision Number 90/PUU-XXI/2023.

In this regard, the KPU should consult with the DPR and the government after the Constitutional Court Decision. Consultation is needed so that PKPU Number 19 of 2024 which regulates the Presidential Election technique can be revised immediately.

Because of this, Hasyim received a stern warning from the DKPP. However, these sanctions did not deter Hasyim.

2. Accommodation of the Supreme Court's decision regarding the minimum age limit for regional head candidates

The second Hasyim Asy'ari controversy is to accommodate the decision of the Supreme Court (MA) which granted the change in the interpretation of the minimum age limit for regional head candidates calculated at the inauguration, not when the candidate pair was appointed after registration as before.

This decision was accommodated by the KPU by issuing PKPU Number 8 of 2024 concerning the Candidacy of Governors and Deputy Governors, Regents and Deputy Regents, as well as Mayors and Deputy Mayors.

This step is considered inconsistent with the constitution, because the Supreme Court's decision only cancels the rules at the PKPU regarding changes to the minimum calculation of the age of regional head candidates. The KPU should follow the terms of age requirements for regional head candidates in the Pilkada Law that have not changed.

The public also suspects that the Supreme Court's decision and the KPU's steps are full of interests. This is because the provision opens the door for PSI General Chair Kaesang Pangarep to run as a candidate for governor in the 2024 Pilkada.

Please note, President Jokowi's youngest son will even be 30 years old on December 25, 2024 when the regional head candidate has been determined.

The old rules cannot make Kaesang compete in the Pilkada. Meanwhile, the new rules make Kaesang meet the requirements for the age of the regional head, because he is 30 years old if the inauguration is held in 2025.

3. Alleged harassment to Golden Woman

Hasyim Asy'ari was also hit by the issue of alleged sexual harassment against the Chairman of the Republic of One, Hasnaeni or who is familiarly known as the 'Golden Woman'.

This case was then followed up by the DKPP and made Hasyim have to undergo a trial for alleged ethical violations.

The results of the trial stated that Hasyim was not proven to have sexually harassed him. However, DKPP still imposes sanctions on Hasyim because of his close relationship with Hasnaeni.

4. Accused of foya-foya using a private jet

Hasyim Asy'ari was also accused of using private jets while serving as chairman of the Indonesian KPU. The accusation was made by a member of Commission II of the DPR from the Golkar faction, Riswan Tony.

Related to this, Hasyim denied having done the spree. He admitted that he rented a jet so that the ballots could reach the voters on time.
