Jumardi, Arrested For Selling 10 Bayan Birds, Submits A Preliminary Lawsuit To The West Kalimantan Regional Police Chief

PONTIANAK - Jumardi who was arrested for selling 10 parrots filed a pretrial suing the Kalbar Police Chief. In the first trial, the Kalbar Police Chief as the defendant did not attend the court.

"Through a legal attorney, Jumardi has officially registered a pretrial for the case of selling 10 Bayan birds. Today the first trial has started but the defendant pretrial, namely the Head of the Regional Police of West Kalimantan, has not been present so the trial is postponed until March 19, 2021," said Jumardi's legal advisor , Andel, at the Pontianak District Court quoted Antara, Friday, March 12.

Andel explained that the basis of the pretrial hearing was the matter of the procedure for the arrest of his client, Jumardi.

"The problem with the pretrial hearing is related to the issue of the authority to make an arrest, the procedure for determining Jumardi as a suspect, detention, and confiscation of the goods used. We will convey this in full after the pretrial proceedings with the defendant, "he said.

Andel was concerned about the problems that befell Jumardi and said Jumardi's position was like eating simalakama fruit.

"Jumardi's condition is indeed similar, since the Covid-19 pandemic, he, who previously worked in Malaysia, had to be deported. He himself has worked for a palm oil company, but due to economic difficulties to eat rice and milk for his son, he sells parrots through his Facebook account, ”said Andel.

Andel also explained that Jumardi's ignorance regarding the parrot (Eclectus rotatus), which is a protected animal, is also a problem.

"This is also due to ignorance of the rules that the parrots are protected by law. If he knew it would not be possible to do so. He also sold 10 birds for Rp750,000," he said.

Previously, Jumardi, who is usually called Jumar, a resident of Tempakung Hamlet, RT 01, RW 01, Tempatan Village, Sebawi District, Sambas Regency, was arrested by the West Kalimantan Regional Police for allegedly selling protected parrots.

Parrots have been protected by Law Number 5/1990 concerning the Conservation of Living Natural Resources and their Ecosystems by inclusion as an attachment list to Government Regulation Number 7/1999 concerning the Preservation of Wild Plant and Animal Species.
