Avoid Conflict Of Interest, The Constitutional Court Ensures That Judge Arsul Sani Does Not Participate In Handling The Dispute On PPP Results

Constitutional Justice Arsul Sani will not participate in handling the dispute over the results of the legislative general election (PHPU) from the United Development Party (PPP).

This was confirmed by the Spokesperson for the Constitutional Court (MK) Enny Nurbaningsih to reporters, Monday, March 25.

Apart from the PPP dispute, continued Enny, Arsul Sani could still participate in handling the dispute over the results of the 2024 Pilleg.

"His Majesty Mr. Arsul did not participate in handling the PPP case. Apart from PPP, he carried out his function as usual," said Enny.

Enny said the handling of the 2024 Legislative PHPU case would be divided into three panel of judges. Each panel consists of 3 judges in the Constitutional Court and each panel is led by the Chief Justice of the Constitutional Court Suhartoyo, Deputy Chief Justice of the Constitutional Court Saldi Isra, and the judge of the Constitutional Court Arief Hidayat.

Arsul Sani will still be in one of these panels and will not handle disputes related to PPP.

"Given that the panel of judges in the legislative election is divided into 3, the contents are 3 judges. If there are panels that are less than 3 judges, they cannot convene. Meanwhile, the legislative trial is limited in time," said Enny.

For the dispute over the results of the 2024 presidential election, said Enny, Arsul Sani could use his deviation rights. The reason is, PPP is one of the parties that carries the presidential and vice presidential candidates number 3 Ganjar Pranowo and Mahfud MD who are the applicants for the 2024 presidential election results dispute.

"For the presidential election, you can use the right to deny it," concluded Enny.

It is known that Arsul Sani has officially become a constitutional judge or MK since January 18, 2024, replacing Wahiduddin Adams, who is serving his full term because he has entered retirement age for 70 years.

Arsul Sani is one of the judges proposed by the DPR. Before becoming a judge at the Constitutional Court, Arsul Sani was the deputy chairman of the PPP and a member of Commission III of the DPR.
