Ihsan Yunus Name Missing On Social Assistance Bribery Charges, ICW Encourages Death To Summon KPK Leaders

JAKARTA - Indonesia Corruption Watch (ICW) has highlighted the loss of the name Ihsan Yunus in the indictment for the social assistance bribery case. ICW encouraged the Supervisory Board (Dewas) to summon the KPK leadership to clarify this issue.

The loss of Ihsan Yunus' name was highlighted by ICW in connection with the indictment for the accused Harry Van Sidabukke. The indictment explains the role of the defendant from the private sector who gave money to get part of the social assistance project.

"However, when the indictment was read further, it was found that there were many very significant irregularities, especially regarding the disappearance of the names and roles of certain parties," said ICW's statement, Friday, February 26.

ICW explained, the preparation of the indictment has been regulated in Article 143 of the Criminal Procedure Code, which reads "the indictment letter must be described carefully, clearly and completely regarding the criminal act charged". However, this rule, called ICW, was not applied by the KPK public prosecutor when drafting the indictment letter for the accused Harry Van Sidabukke.

"ICW found two irregularities in the indictment. First, the indictment did not mention the name of Ihsan Yunus, a politician from the PDIP. Whereas on February 1, to be precise in the reconstruction forum, the name concerned appeared because he was suspected of receiving a flow of funds of Rp. 6.7 billion and two Brompton bicycles through Agustri Yogasmara, "continued ICW.

Second, on page five of the indictment, the public prosecutor only mentioned Agustri Yogasmoro as the owner of the quota for the basic food assistance package. Meanwhile, in the case reconstruction, the KPK continued, ICW said that Agustri Yogasmoro was acting as the "Ihsan Yunus operator".

"The next question is, why is this not mentioned in the indictment? Therefore, it is not wrong if the public suspects that there are efforts from the internal KPK - leaders, deputies, or directors - who do not want to develop this case, "said ICW.

ICW emphasizes case reconstruction as an effort by the KPK to strengthen the allegation of corruption against Harry Van Sidabukke.

"If in this activity Harry is suspected of giving a certain amount of money and goods to a state official, isn't that a criminal offense? Then linked to the indictment, is Harry's action not considered important to be proven in the trial forum? " connect ICW.

Therefore, ICW asked the KPK Supervisory Board (Dewas) to summon the KPK leadership regarding the loss of the name Ihsan Yunus.

"If an element of intent is found, the Supervisory Board must impose sanctions on the person who commits the action," said ICW.
