Defendant Of Extortion Of Gilimanuk's Cekik Balance Office Sentenced To 7 Years In Prison Plus IDR 2.5 Billion In Pengunti Money

DENPASAR - Denpasar District Court Judge, Bali, sentenced I Made Dwi Jati Arya Negara (49), a defendant in a case of illegal levies at the Motor Vehicle Weighing Implementation Unit (UPPKB) Cekik Gilimanuk, Jembrana.

Defendant I MadeDwi Jati is the Coordinator of the Service Unit at the Office of the Motor Vehicle Weighing Implementation Unit (UPPKB) Cekik Gilimanuk, Jembrana.

The verdict was read by the Chairman of the Panel of Judges Heriyanti and members of Soebekti and Nelson during a trial at the Corruption Court at the Denpasar District Court, Bali, Friday, February 16.

"The trial, sentenced the defendant to 7 years in prison, reduced while in detention with an order that the defendant remains detained. Sentencing a fine of Rp. 300 million, subsidiary to 6 months in prison," said Heriyanti as quoted by ANTARA.

The judge stated that the defendant was legally and convincingly proven to have committed a criminal act of corruption as regulated in Article 12 letter e in conjunction with Article 18 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) 1st in conjunction with Article 64 paragraph (1) of the Criminal Code.

In addition, the defendant was required to pay compensation of Rp2,521,484,999. If the defendant did not pay the replacement money after one month the court's decision obtained legal force, then the defendant's property could be confiscated by the prosecutor for auction.

If the defendant does not have sufficient property, he will be replaced with a one-year prison sentence.

The judge's decision is two years higher than the demands of the Bali High Prosecutor's Office, which charged the defendant with 5 years in prison.

Previously, the defendant I MadeDwi Jati Arya Negara together with I Putu Nurbawa and Ida Bagus Ratu Saputra (separate prosecution files) were jointly charged with illegal levies against the driver who crossed the Gilimanuk Motive Weighing Bridge, Jembrana, Bali.

The defendant Arya Negara and two other defendants were caught in a hand arrest operation (OTT) from the Bali Police Extortion Saber Task Force on April 11, 2023.

They were arrested for committing extortion, namely asking for money from truck drivers who passed the Cekik weight bridge at a rate of Rp. 20,000 to Rp. 200,000 each time they crossed depending on the violation they got. However, the money was used for their personal needs.

In this case, the defendant Arya Negara as the Korsatpel UPPKB Cekik abused his authority by ordering the regulatory commander, members of his squad and staff to collect money from passing goods transport drivers.

The other two defendants, namely Gusti Putu Nurbawa, who is a civil servant (PNS) at the Ministry of Transportation as a guard officer and Ida Bagus Ratu Suputra as a contract employee who served as traffic staff, had received a verdict from Denpasar Corruption Court judge with a one-year prison and a fine of Rp. 10 million.
