Commission IX Asks The Government To Cancel The BPJS Contribution Increase

JAKARTA - The Supreme Court (MA) canceled the increase in contributions from the Health Social Security Administering Body (BPJS). The cancellation was carried out through a judicial review decision on Presidential Regulation Number 75 of 2019 concerning Health Insurance.

Quoting from its decision document, the Supreme Court stated that Article 34 Paragraph 1 and 2 of Presidential Decree Number 75 of 2019 concerning Health Insurance, contradicts a number of other laws. So that the reason for raising the BPJS contribution is not right, based on the verdict ruled by the Supreme Court on Thursday, February 27.

"Rejected because they do not have binding legal force," said MA spokesman Andi Samsan Nganro in a short message, Monday, March 9.

Responding to this, Deputy Chairman of Commission IX Nihayatul Wafiroh said that his party hopes that the government, in this case the Ministry of Finance, can immediately take strategic steps to implement the Supreme Court decision.

"Of course we really hope. We, Commission IX have been struggling extraordinarily for the non-payment of BPJS Health dues, especially class III. Alhamdulillah, MA canceled the increase in BPJS contributions," said Nihayatul when confirmed by VOI.

According to Nihayatul, right now what must be considered is how to overcome the shortage of debt costs borne by BPJS without having to increase contributions from participants.

Meanwhile, Member of Commission IX Saleh Daulay asked the government to immediately implement the decision. This is because this decision is stated in the mandate of the Supreme Court which is one of the pillars of democracy.

"We hope that this decision must be implemented by the government soon," he said.

Apart from that, Saleh also urged the government to continue to provide services according to the proper standards, even though the increase that had been determined by the government was not enforced.

"We hope that later the government, together with the DPR and all other components of society, will find the best solution related to the deficit and lack of funding for the implementation of BPJS Kesehatan. While with that, of course we may also need to evaluate the laws and regulations related to our social security system," he said.

According to Saleh, the Supreme Court must immediately provide a copy of the decision to the government and related parties, in this case of course the Ministry of Health, Ministry of Social Affairs, the President and BPJS Kesehatan. So, there is no reason for the government and operators to keep raising this.

"Because later there could be reasons for not receiving the decision. To avoid that, a copy should be given immediately," he explained.

In detail, President Joko Widodo signed Presidential Regulation (Perpres) Number 75 of 2019 concerning Amendments to Presidential Regulation Number 82 of 2018 concerning Health Insurance.

1) Contributions for PBPU Participants and BP Participants are:

a. IDR 42,000.00 (forty-two thousand rupiahs) per person per month with service benefits in Class III treatment rooms.

b. Rp110,000.00 (one hundred and ten thousand rupiahs) per person per month with service benefits in Class II treatment rooms; or

c. Rp160,000.00 (one hundred and sixty thousand rupiah) per person per month with service benefits in Class I treatment rooms.

(2) The amount of the Contribution as referred to in paragraph (1) shall come into effect on January 1, 2O2O.

With the cancellation of the article above, BPJS contributions will return to their original contributions, namely:

a. IDR 25,500 for class 3

b. IDR 51,000 for class 2

c. IDR 80,000 for class 1
