MATARAM - Abdurrazak Al Fakhir, former Head of the Haj Embarkation Boarding House for Lombok, West Nusa Tenggara, was charged with one year and six months or 18 months in prison.
Public Prosecutor Fajar Alamsyah Malo in his complaint at the Mataram Corruption Eradication Court said that the defendant Abdurrazak was proven to have committed corruption against non-tax State Revenue (PNBP) funds for building leases in 2014.
"As a result of the defendant's actions, there was a state loss of Rp. 484.26 million," Fajar said as quoted by Antara, Thursday, February 4.
Fajar explained, the emergence of the state loss figure was based on the Inspectorate of NTB Inspection Report (LHP) which stated that the UPT Haji Dormitory received PNBP from building leases amounting to Rp1.4 billion.
However, only Rp996.18 million was deposited in the state treasury. There was a difference of Rp. 484.26 million which was later discovered to have been used by the defendant Abdurrazak and his treasurer, Iffan Jaya Kusuma for personal needs and service guest services.
Because of this, the defendant Abdurrazak was also charged with paying a fine of Rp. 50 million, a subsidiary of three months in prison.
In addition, Razak was also demanded to compensate for state losses of Rp. 484.26 million. If the provisions are not replaced, the property will be confiscated to be auctioned off. If you don't have any assets, you must replace them with nine months imprisonment.
In relation to this figure of state losses, Abdurrazak had previously entrusted it gradually through the prosecutor with details of Rp. 15.37 million, Rp. 47.58 million, Rp. 45 million, Rp. 88 million, and finally Rp. 288.31 million.
Fajar said the return of the state's losses was a consideration for the prosecutor to demand 18 months in prison for the accused Abdurrazak.
In his indictment, the prosecutor charged the defendant Abdurrazak in accordance with the charges under Article 3 in conjunction with Article 18 of the Law on the Eradication of Corruption.
Likewise with his subordinates who acted as treasurers of Iffan Jaya Kusuma. The prosecutor applied a similar charge to the defendant Abdurrazak. However, for Iffan, the prosecutor did not charge him to compensate the state for losses.
After hearing his demands, the panel of judges led by Agung Prasetyo with members of Abadi and Fathurrauzi, invited the two defendants to submit a defense note on the agenda for the next trial which will be held next week.
Meanwhile, Abdurrazak's legal adviser, Umaiyah, said that his party would submit a defense note for the defendant next week asking for leniency.
"Our client already regrets his actions and compensates all state losses. So we will ask for a minimal punishment," said Umaiyah after the trial.
