Restorative Justice Approach As Healing Justice In The Habib Rizieq Case

JAKARTA - Members of Commission III of the DPR from Gerindra fraction, Habiburokhman, in a work meeting with the Attorney General's Office suggested the Habib Rizieq Shihab case to be resolved by means of a restorative justice approach, Tuesday, January 26.

Habiburokhman thought that the restorative justice approach could be applied to Habib Rizieq Shihab's crowd case. According to him, the cases were not only rested on Rizieq.

Some legal experts consider restorative justice to be a paradigm in criminal law reform in Indonesia. One of the experts who put this forward is Prof. Mardjono Reksodiputro, BL, MA.

Reported by VOI from Women's Journal, Prof. Mardjono stated that restorative justice is an approach that aims to build a criminal justice system that is sensitive to the problem of victims.

Restorative justice is also important in relation to crime victims, because this approach is a form of criticism of the criminal justice system in Indonesia.

Prof. Mardjono argued that currently criminal justice has a tendency towards retributive objectives or emphasizing justice in retaliation.

In addition, the judiciary in Indonesia is considered still and ignores the role of victims in participating in determining the process of the case.

Meanwhile, members of the National Criminal Code Reform Alliance, Zainal Abidin, BL, M. Law & Dev explained the urgency of the justice restoration approach in the legal and criminal justice system in Indonesia.

According to Zainal, this approach has changed the concept from just punishing and isolating the perpetrator.

The restorative approach also acts as "healing justice" or a way of approaching the problem of crime by dealing with the damage with the aim to reduce the damage through a holistic process, respecting the parties, repairing damage, and creating change.

However, up to this time, restorative justice is still considered by legal experts to be closely related to the trial of criminal cases for children and women. So, was it effective when applied to the Habib Rizieq case?
