JAKARTA - The National Human Rights Commission of the Republic of Indonesia (Komnas HAM RI) urges the South Sulawesi Police Chief to grant health rights to the suspect former President Director of PT Citra Lampia Mandiri (CLM) Helmut Hermawan, who is currently sick and detained.

The recommendation was issued after his party received an audience with Helmut Hermawan's attorney, Rusdianto Matulatuwa, on Tuesday, March 7, 2023.

"In essence, the complainant reported allegations of arbitrariness in fulfilling the health rights of Helmut Hermawan when he was detained and arrested as a suspect in a criminal act of ordering to place false information in an authentic deed and alleged criminal acts of forgery of letters in the Police Report Number LP/B/0537/1X/2022/SPKT/Bareskrim Polri," said Komnas HAM Complaint Commissioner Hari Kurniawan in his statement, Saturday, March 25.

To note, Helmut Hermawan is currently in a fairly serious illness which causes it to be difficult to wake up and therefore submits an application to be able to undergo health care.

"But not given permission by the Director of Special Criminal Investigation (Ditreskrimsus) of the South Sulawesi Police, they still have to undergo examination of their case," he continued.

Komnas HAM said that the right to health for people who were deprived of their independence was guaranteed in Article 10 paragraph (1) of Law Number 12 of 2005 concerning the Ratification of International Conventions on Civil and Political Rights, and Article 10 of the Regulation of the Head of State Police of the Republic of Indonesia Number 8 of 2009 concerning the Implementation of Principles and Standards of Human Rights in the implementation of Tasks of the Indonesian National Police.

Responding to this, Trisakti University Law Observer Abdul Fickar said that the right to health is one of the human rights that must be respected.

"The National Police Chief and even the South Sulawesi Police Chief actually have to give this right to Helmut Hermawan. Because this concerns human rights," said Fickar.

"The presumption of innocence must be put forward, so all Helmut rights, especially the right to health as a human, must be given, if it does not mean that the police violate the law," said Fickar.
