Covering Rizieq Shihab's Positive COVID-19 Status Which Turns To Criminal

JAKARTA - Bareskrim Polri has named three suspects in a case that allegedly obstructed the work of the COVID-19 Task Force at Ummi Hospital, Bogor. The three of them, Rizieq Shihab, Hanif Alatas, and the Managing Director (Managing Director) of Ummi Hospital, doctor Andi Tatat.

The Director of General Crimes at Bareskrim Polri, Brigadier General Andi Rian, said that the determination of the three suspects was based on the results of their case titles. From the pekara title, investigators found elements of the crime the three had committed.

"Yes, the three of them have been named as suspects," Rian told VOI, Monday, January 11.

Determination of suspects by investigators is also based on evidence. However, Andi was reluctant to explain in detail the evidence used. The reason is that this is entirely the authority of the investigator.

"What is certain is that investigators already have at least 2 pieces of evidence to determine them as suspects," said Andi.

With the determination of this suspect, investigators used Article 14 paragraphs 1 and 2 of Law Number 4 of 1984 concerning Disease Outbreaks, Article 216 of the Criminal Code, and Articles 14 and 15 of Law Number 1 of 1946 concerning Criminal Law Regulations.

Although previously he did not explain the evidence used, Andi explained a little about the reasons for the application of Articles 14 and 15 of Law No.1 of 1946 concerning Criminal Law Regulations in this case.

This article regulates the basic question of prosecuting the act of broadcasting fake news. The use of this article was because the three suspects spread false information when Rizieq Shihab was undergoing treatment at Ummi Hospital, Bogor.

Hanif Alatas was accused of this article because it did not provide real information. At that time, he said that Rizieq Shihab's condition was fine. In fact, what actually happened was that Rizieq had been confirmed positive for COVID-19.

Then, he was also charged with another article for obstructing the work of the COVID-19 Task Force.

"It is known that (Rizieq) was already positive (COVID-19) on November 25, 25. But on November 26 they said there was no problem, in good health, there was no illness whatsoever. It was spread through Front TV," said Rian.

Meanwhile for Andi Tatat, the same article was applied because at that time he gave information through the media that Rizieq Shihab was in good condition. In fact, the opposite is true.

"Ummi Hospital was asked by the media, at that time there was a press conference, there was," he said.

In addition, Andi Tatat was also considered to have obstructed the Task Force's work because he was not cooperative when the Task Force was about to check Rizieq Shihab's health condition. In fact, Ummi Hospital is a referral hospital for handling COVID-19.

"(Andi Tatat) The person in charge there. And Ummi Hospital is a COVID referral hospital. There are obligations that he must carry out for the task force. If he does not want to work together, don't be a referral hospital," he said.

Then, the investigators follow up in this case to examine the suspects. The plan is that investigators will examine them on Friday, January 15.

"The plan is for Friday (the three suspects are investigated)," said Andi.

It is possible that the investigation of Rizieq Shihab will take place at the Jakarta Metro Police Narcotics Detention Center. Meanwhile, Hanif Alatas and Andi Tatat will be questioned at Bareskrim Polri.

Later, after the investigation of the three is complete, the investigator will conduct a case title. In this title of struggle will be decided about the detention of the suspects.

"The plan is that (detention will be discussed after the examination)," said Andi

This case began when the Bogor City Ummi Hospital was reported to the police because it was considered to be blocking the work of the COVID-19 Task Force. The hospital is said to have not provided a complete explanation of Rizieq Shihab's COVID-19 swab examination.

The report is registered with the number LP / 650 / XI / 2020 / JBR / Bogor City Police, dated November 28, 2020, made by the COVID-19 Task Force.

However, the Managing Director of Ummi Hospital Andi Tatat denied that Rizieq Shihab and his family had fled from the hospital. Rizieq is said to have returned home at the request of his family.
