The Case Of The Theft Of Five Palm Oil Fruit Plants In South Kalimantan Was Stopped Via Restorative Justice

The South Kalimantan High Prosecutor's Office has released two defendants who stole five boxes of fresh palm fruit for Rp. 450 thousand in Kotabaru Regency. The Deputy Attorney General for General Crimes (Jampidum) approved the application of restorative justice.

"After the results of the exposure with Jampidum, the leadership has approved the termination of prosecution," said Head of the South Kalimantan Prosecutor's Office Mukri, in Banjarmasin, Friday, January 27, quoted from Antara.

Mawardi and Supriyanto were initially suspected of violating Article 372 in conjunction with Article 55 in conjunction with Article 53 of the Criminal Code after being arrested by the police for stealing fresh palm fruit bunches at the SKPA Plasma Division I plantation in Sidomulyo Village, Kelumpang Hulu District, Kotabaru Regency on November 22, 2022.

Mawardi is known to work as a manual driver for fresh palm fruit bunches and has the task of being a freelance daily laborer who transports from the plantation area to the TPA.

While working to transport palm fresh fruit bunches to the TPA, the suspect set aside five pieces of coconut fresh fruit bunches into a ditch on the way to the TPA, with the aim of selling them after work.

Then after finishing work, the suspect asked Supriyanto for help in transporting him by car.

PT SKPA Cantung Plasma Sinarmas admitted that it suffered a loss of Rp. 450 thousand and asked the perpetrators to be prosecuted by the police based on the company's report.

Mukri said that the termination of prosecution by the Kotabaru Kejari was based on various considerations, such as the suspect for the first time committing a crime, the threat was no more than five years and the loss suffered by the victim was not more than Rp. 2,500,000 and there was a peace agreement.

"So for small cases that can be reconciled, we continue to encourage them to be resolved outside the court through restorative justice," he also said.
