Criticism Of The Elimination Of Long Leave To Holidays Only One Day, Legislators: Work Creation Perppu Not For Workers But Investors

JAKARTA - Member of Commission IX of the Indonesian House of Representatives, Lucy Kurniasari, criticized the Government Regulation in Lieu of the Law or the Job Creation Perppu for changing the rules for rest time and leave which were deemed not in favor of workers. The Perppu abolishes the rules of long leave and regulates holidays for only one day a week. In fact, according to him, long leave is a right that should be given to workers. However, in this Perppu the company does not have the obligation to give this right. "Through long leave, it is hoped that workers can recover physically and psychologically so that they can return to work more fit and improve their performance," Lucy told reporters, Monday, January 2. In the Job Creation Perpu, the rules regarding rest time and leave are contained in article 79. However, this Perppu abolished paragraph d point 2 of the Manpower Law Number 13 of 2003 which regulates the issue of long rest. If previously the long rest was regulated in the Manpower Law with a minimum duration of 2 months, the rules regarding the long rest in the Job Creation Perpu are regulated in work agreements, company regulations, or work agreements with certain companies. Meanwhile, regarding the number of working days which has been increased to 6 days with a 1 day holiday, according to him, the provision of work for 5 days a week is sufficient. So that workers can rest in the next 2 days. " “ Work productivity is not determined by the length of work, therefore, five working days a week is enough," said the Democrat legislator. Lucy assessed that the regulation in the Job Creation Perppu did not create legal certainty for workers. According to him, Perppu is more in favor of investors and employers, not workers. “ The government does not issue a Perpu for legal certainty for workers. This means that the motive issued by Perppu is not for the benefit of workers, but rather for investors,” he explained. Luci added that the issuance of the Ciptaker Perppu also seemed forced during the DPR RI recess. In fact, he said, there was nothing urgent to issue a Perppu. Then regarding the impact of the Russia-Ukraine war which became the reason the government issued the Perppu, Luci emphasized that it could not be used as a basis for issuing the Perppu. Therefore, Lucy hopes that after the recess period the DPR RI rejects the Job Creation Perppu. Therefore, after the recess later the DPR RI should reject the Perppu. That way the DPR will not only become a government stamp institution," he concluded.
