Komnas HAM: The Tragedy Is Not A Gross Violation Of Human Rights

JAKARTA - The National Human Rights Commission (Komnas HAM) stated that the humanitarian tragedy at the Kanjuruhan Stadium, Malang, East Java on October 1, 2022 was not categorized as a gross human rights violation. "Based on reports, there are no serious human rights violations," said the Coordinator of the Human Rights Enforcement Sub-Commissioner/Commissioner for Monitoring and Investigation of the Commissioner for Supervision of Komnas HAM Uli Parulian Sihombing in Jakarta, Antara, Thursday, December 29. The report referred to by Uli refers to the report on monitoring and investigating the humanitarian tragedy at the Kanjuruhan Malang Stadium, October 1, 2022, issued by Komnas HAM on November 2, 2022. "For the case of the humanitarian tragedy in Kanjuruhan, Komnas HAM refers to the monitoring report," he said. Currently, he continued, Komnas HAM is monitoring recommendations from the monitoring report carried out by the human rights institution. Referring to the Komnas HAM report dated November 2, 2022, there are several conclusions, including Komnas HAM stating that the tragedy of Kanjuruhan is an event of human rights violation that occurs due to football governance which is organized by not implementing, respecting and ensuring the principles and norms of safety and security of football. In addition, because of the exerciseive use of force, there is a security system that violates PSSI and FIFA rules with the involvement of the police and the TNI, including the entry of tear gas and the shooting of tear gas, the use of prohibited security symbols and vehicle facilities. The violation of PSSI and FIFA rules occurred because security designs in all football matches that were PSSI's responsibility not to pay attention to safety principles, and security in PSSI and FIFA regulations. Separately, Coordinating Minister for Political, Legal and Security Affairs Mahfud MD in a Twitter tweet said the tragedy of Kanjuruhan was not a gross human rights violation. The statement by the former Chief Justice of the Constitutional Court referred to the Komnas HAM investigation. "Can I say that the case of the Kanjuruhan tragedy is not a serious human rights violation?" Mahfud tweeted on the Twitter account @mohmahfudmd on Wednesday. In the tweet, Mahfud said that according to the law, there were gross human rights violations or not, namely only Komnas HAM.
