JAKARTA - Head of the DKI Jakarta Restoration Session Team (TSP) Boy Bhirawa said the HI Roundabout Transjakarta Bus Stop, which is now being revitalized, violated procedures related to preserving cultural heritage.

Because, the design of the new HI Roundabout Bus Stop will later be said to hinder the view of the Hi Roundabout Welcome Statue. This, said Boy, also has the potential to violate Law Number 11 of 2010 concerning Cultural Conservation.

"That's right, (The HI Roundabout Bus Stop) has the potential to violate the law," Boy told reporters, Thursday, September 29.

This refers to Article 55 of the Cultural Conservation Law which states that everyone is deliberately prohibited from preventing, obstructing, or thwarting cultural heritage conservation efforts.

However, according to him, the content of regulations in the Cultural Conservation Law does not explicitly regulate the visual barrier from the HI Roundabout area which is designated as the alleged cultural heritage object (ODCB).

"Indeed, in general it is not clearly stated, it is only not allowed to be hindered. However, this visual must also be checked again whether it is explicitly stated that it is. However, ethically against cultural heritage is a problem. If it is ethical, not everything is clear and detailed," explained Boy.

Even so, from this condition, people who think that the HI Roundabout Bus Stop violates the rules can file a class action lawsuit against PT Transjakarta.

"The most likely thing is whether there are objections from the city residents to their whereabouts. If there is correct guidance, it will only be proven later whether he is capable of class action, accepted as an objection from residents, there are many signatures for referendum, objections to his whereabouts," he explained.

Furthermore, Boy views, PT Transjakarta should have asked for recommendations from the TSP and the Cultural Conservation Expert Team (TACB) before constructing the revitalization of the bus stop near the cultural heritage area. This recommendation is produced from expert studies.

"So all objects suspected of cultural heritage should have gone through the restoration team of the Restoration Session Team," said Boy.

Not to mention, there will be elements of commercialization that will be carried out, namely tenants, when the iconic bus stop operates. Commercialization around the cultural heritage area clearly violates ethics.

"In this bus stop case, no building has been damaged. The visual condition (Welcome) that is hindered is not implicitly stated, but this should be scientifically understood," said Boy.

"Otherwise, all stakeholders fight for public spaces to stand out and look for each other for income sources, to become commercial," he said.
