Children Aged Not 14 Years, Male Boy Suspected Of Being A Perpetrator Of Sexual Harassment In Cilincing Jakut Not Detained

JAKARTA - The North Jakarta Metro Police are handling the alleged case of sexual violence in the North Jakarta City Forest in accordance with Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA). So based on the law, the perpetrators cannot be detained because they are not even 14 years old.

"So, I need to emphasize here that we are still processing this case. However, the detention of this child is regulated in Article 32 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System is a minimum of 14 years," said the Head of the Jakut Police, Police Commissioner Wibowo, to reporters in North Jakarta, Saturday, September 17.

Wibowo explained that the legal process for alleged cases of sexual violence in the Rawa Malang City Forest, East Semper, Cilincing, North Jakarta on September 1 at around 17.30 WIB, was still ongoing.

Officers have arrested four children for allegedly committing sexual violence against a 13-year-old girl in the Rawa Malang City Forest, North Jakarta, as soon as she received a report on this incident on September 6.

The police have also examined information from those who are aged 12 to 14 years and revealed the motive was because the victim rejected the statement of love for one of them.

"Indeed, this victim was returning home from school to meet these four people because one of them was once rejected by his love by the victim," said Wibowo.

After being arrested, said Wibowo, they were not repatriated, but entrusted to the Legal-Faced Child shelter in Cipayung, East Jakarta because they could not be detained according to Article 32 of the SPPA Law.

Furthermore, Wibowo said that maybe a misunderstanding arose when the police applied it to one of them because they were subject to a special article, namely Article 32 of the SPPA Law and he was still 12 years old.

Wibowo also said that his party had coordinated with related parties such as the Correctional Agency, the Indonesian Child Protection Agency, the Integrated Service Center for Women and Children as well as the suspect's lawyer.

"Coordination to determine whether the child is handed back to the parents or taking a training education for six months," he said.

His party on Wednesday (September 14) scheduled this, however, the activity was canceled because it was not attended by the victim's family.

"The legal process against the juvenile justice system is indeed a very long mechanism. So, this deserves to be known to the public," said Wibowo.
