Bawaslu Refuses To Follow Up Reports Of Zulhas Distributing Cooking Oil To Campaign For His Daughter, Read This Law It's Not Yet General Election

JAKARTA - The General Elections Supervisory Agency stated that reports from the public with reported Zulkifli Hasan (Zulhas) regarding alleged campaign violations outside the schedule could not be followed up.

"Thus, the report cannot be registered and followed up. Bawaslu will announce the status of this report on the notice board at the Bawaslu Office," said Bawaslu member Puadi as quoted by ANTARA, Wednesday, July 20.

Based on the study, Bawaslu concluded that the report numbered 001/LP/PL/RI/00.00/VII/2022 did not meet the material requirements.

"Bawaslu has reviewed community reports with reported Zulkifli Hasan regarding alleged campaign violations outside the schedule. In conclusion, the report does not meet the material requirements of the report so it cannot be registered," he said.

According to Puadi, after the report was submitted on Tuesday 19 July 2022, Bawaslu conducted an analysis of the events reported by the reporter.

The analysis is carried out based on article 1 number 35 of Law Number 7 of 2017 concerning Elections, which states that election campaigns are activities of election participants or other parties appointed by election participants to convince voters by offering their vision, mission, program and/or self-image of election participants.

According to Bawaslu, based on KPU Regulation Number 3 of 2022 concerning the schedule and stages of holding the 2024 general election, it is known that at this time there are no participants in the 2024 election.

This means that the reported actions as reported cannot be qualified as election campaign activities. In addition to these norms, Bawaslu also considers Article 280 paragraph (1) of the General Election which regulates the prohibition of actions taken in campaign activities.

The fourth part of the legislation states that election campaigners, participants and teams are prohibited from using government facilities, places of worship, and places of education. It is also prohibited to promise or give money or other materials to election campaign participants.

Meanwhile, Article 281 paragraph (1) of the Election Law stipulates that election campaigns involving the president, vice president, ministers, governors, deputy governors, regents, deputy regents, mayors, and deputy mayors must fulfill the provisions of not using facilities in their positions.

Except, he continued, security facilities for state officials as regulated in the provisions of laws and regulations, and must undergo leave outside the state's responsibility.
