Ask Anies To Immediately Decide On Appeal Or Not Regarding The DKI UMP, PDIP: Hanging It Makes All Parties Uneasy

JAKARTA - Chairman of the PDIP Faction of the DKI Jakarta DPRD Gembong Warsono asked DKI Jakarta Governor Anies Baswedan to immediately decide on further steps in dealing with the Jakarta Administrative Court decision regarding the DKI Jakarta provincial minimum wage (UMP) in 2022.

In its decision, the Jakarta Administrative Court ordered Anies to revoke the decree (SK) regarding the determination of the UMP and ordered Anies to lower the UMP from Rp. 4.6 million in the decree to Rp. 4.5 million according to the recommendation of the Wage Council of DKI Jakarta.

Meanwhile, until now the DKI Jakarta Provincial Government has not complied with the PTUN decision. Even the Provincial Government of DKI opened the opportunity to file an appeal.

"If you are not sure about the decision (SK UMP), then obey the decision of the Administrative Court. However, if you really want to appeal, it will be done as soon as possible so that there will be legal certainty. Don't hang it. If you hang it will make all parties nervous," said Gembong when contacted , Thursday, July 14th.

Gembong suggested that if he would comply with the PTUN's decision, the DKI Provincial Government should hold discussions with groups of employers and workers to find a solution to the UMP polemic.

"Let's say the provincial government follows the PTUN, then immediately sit down together between entrepreneurs, workers, and the provincial government. Then, the PTUN decision becomes a mutual understanding between the provincial government, employers and workers," he said.

Meanwhile, if he is firm with his stance, Gembong asks the DKI Provincial Government to immediately file an appeal to fight back against the PTUN decision.

"If you are ready to appeal, then appeal. In this case, you are ready with a study, not just ready with words. If you are just ready, later in court, you will definitely lose again. When you lose again, it will create uncertainty," said Idia .

For information, the DKI Jakarta State Administrative Court (PTUN) canceled the decision of the Governor (Kepgub) of DKI Jakarta Anies Baswedan regarding the 2022 Provincial Minimum Wage (UMP) whose lawsuit was filed by a number of entrepreneurs.

The decision of the Jakarta Administrative Court granted all claims from entrepreneurs. The plaintiffs are the Regional Leadership Council of the Indonesian Employers' Association (Apindo) DKI Jakarta.

In addition to canceling the Gubernatorial Decree, the Jakarta Administrative Court in its ruling also required Anies, as the defendant, to revoke Gubernatorial Decree No. 1517 of 2021 concerning the 2022 UMP which was issued on 16 December 2021.

Another ruling is that Anies obliges Anies to issue a new State Administrative Decree regarding the 2022 UMP based on the recommendation of the DKI Jakarta Wage Council, namely the elements of the labor union Number: I/Depeprov/XI/2021 on November 15, 2021, amounting to Rp4,573,845.

The Jakarta Administrative Court also sentenced Anies as the defendant and the second defendants intervened jointly and severally to pay court fees of Rp. 642,000.
