Unfounded, Public Prosecutor Asks Judges To Reject Exception Of Defendant Abdul Latif In Ade Armando Beating Case

JAKARTA - The Public Prosecutor (JPU) of the Central Jakarta District Attorney (Kejari) asked the panel of judges to reject the exception filed by the defendant on behalf of Abdul Latif in the case of beating UI Lecturer Ade Armando.

"We ask the panel of judges who tried this case to decide to state the objection or exception submitted by the attorney for the defendant Abdul Latif which was read out on Wednesday, July 13, 2022, which was declared rejected and cannot be accepted," said the Public Prosecutor of the Central Jakarta Attorney General's Office, Ibnu at the Central Jakarta District Court, Between, Thursday, July 14th.

The Prosecutor stated that the memorandum of objection submitted was baseless so that it did not need to be considered and was rejected in its entirety.

Furthermore, the prosecutor also said that the exception point regarding the defendant Abdul Latif, who was not accompanied by legal counsel during the legal process at the police and trial, was a matter beyond material matters.

"According to the public prosecutor, it is something that is unclear and does not need to be discussed, because it is not the main issue and is outside the exception material," said the prosecutor.

Therefore, the prosecutor asked the trial of the defendant Abdul Latif to proceed to the proof stage.

"Stating that because of the reasons the defendant's legal team cannot be accepted and must be rejected, the trial on behalf of the defendant Abdul Latif is continued for the proof stage," said the prosecutor.

The next trial will be held on Monday next week at 13.00 WIB with an interim decision on the agenda for the six defendants.

"Next is the turn of the assembly to give a decision on the exception. So for the exception decision the trial was postponed and opened again on Monday, July 18, 2022, at 13.00 WIB by presenting the defendant accompanied by his attorney," said Chief Judge Dewa Ketut Kartana at the Central Jakarta District Court .

Previously, the trial for the interim verdict against the six defendants in the case of beating Ade Armando was scheduled to be held on Wednesday, July 13 yesterday. The six defendants are Marcos Iswan, Komar, Abdul Latif, Al Fikri Hidayatullah, Dhia Ul Haq, and Muhammad Bagja.

The six people were charged with violating Article 170 paragraph (2) of the 1st Criminal Code and Article 170 paragraph (1) of the Criminal Code as subsidiary charges.

However, the trial was forced to be postponed after the defense team for the defendant, Abdul Latif, objected because the trial was the first time his client was accompanied by a lawyer.

It was also said by Abdul Latif's attorney that his client was not accompanied by legal counsel during the legal process and had not submitted an exception.

Chief Judge Dewa Ketut Kartana then suspended the trial for 10 minutes and the trial continued with the reading of an exception by the defendant's attorney Abdul Latif.

The case was recorded at number 368/Pid.B/2022/PN Jkt.Pst with the classification of the case, namely beatings that caused minor and serious injuries.
