Accelerate The Implementation Of The TPKS Law, Director Of IJR Suggests Legal Instructors To Conduct Education

JAKARTA - The executive director of the Indonesia Judicial Research Society (IJRS) Dio Ashar proposes strengthening the role of the community in accelerating the implementation of Law Number 12 of 2022 concerning the Crime of Sexual Violence (UU TPKS).

According to him, strengthening this role by providing education to the community by legal instructors or legal at the community level related to sexual violence, including legal handling that pays attention to the interests of victims.

"If a sexual violence case occurs, it is not resolved through family deliberation, but how to handle the law, law enforcement, and the interests of the victim," he said at an online event entitled Revisiting the (R)UU for the People held by INFID in Jakarta, quoted by Antara, Tuesday. July 12.

He emphasized that this was important considering the reality of the handling of cases that did not meet the existing law enforcement standards as a result of the community's lack of maximum knowledge related to sexual violence.

So far, he said, the reality is that the handling is family-friendly. Many of the victims were actually married to the perpetrators and received compensation.

Another thing that can be done to accelerate the implementation of the TPKS Law, said Dio Ashar, is the immediate issuance of derivative or technical regulations by the Government. This is one of the keys to handling cases or preventing cases of sexual violence.

"Laws are usually more of a norm. However, how to regulate technical matters requires government regulations or more technical regulations," said Dio.

On the other hand, INFID research team member Maidina Rahmawati sees the importance of immediately socializing the TPKS Law considering that there are novelties, both in the context of legal substance and technicality.

This socialization is not only for the community, including community-based service provider organizations that oversee the implementation of the TPKS Law, but also law enforcement officers.

Although community-based service provider organizations have carried out escorts to the TPKS Law, according to him, there must be socialization, training, and education.

"As long as we conduct FGDs and interviews, it has not been intensive after the ratification of the TPKS Law, April 2022," he concluded.
