Project Corruption Case In Bakamla, Managing Director Of PT CMI Teknologi Rahardjo Pratjihno Sentenced To 5 Years In Prison

JAKARTA - President Director of PT Compact Microwave Indonesia Teknologi (PT CMI Teknologi) Rahardjo Pratjihno was sentenced to 5 years in prison plus a fine of Rp. 600 million subsidiary 6 months in prison for being proven to have committed corruption in a project at the Maritime Security Agency (Bakamla) for the 2016 fiscal year.

The project is the procurement of a Backbone Coastal Surveillance System (BCSS) that is integrated with the "Bakamla Integrated Information System" (BIIS) which has resulted in a loss of Rp.63,829 billion in state finances.

"On trial, declaring that the defendant Rahardjo Pratjihno is legally and convincingly proven guilty of committing a criminal act of corruption collectively. Sentencing the defendant to a 5-year prison sentence and a fine of Rp.600 million subsidiary to 6 months in prison," said the head of the panel of judges. Muslim at the Corruption Crime Court (Tipikor) Jakarta, Friday.

The verdict was lower than the charges filed by the KPK Public Prosecutor (JPU) who demanded that Rahardjo be sentenced to 7 years in prison plus a fine of Rp. 600 million, a subsidiary of 6 months in prison based on the primary indictment of article 2 paragraph (1) in conjunction with article 18 of Law no. 31 of 1999 as amended by Law no. 20 of 2001 concerning the Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.

Rahardjo was also obliged to pay a replacement fee of IDR 15.14 billion in accordance with the profits he received.

"To punish the defendant with an additional penalty in the form of paying replacement money to the state in the amount of Rp.15.14 billion on the condition that if within 1 month after the court verdict has permanent legal force and the defendant has not paid the replacement money, his property is confiscated and auctioned off to cover the replacement money and If they do not have sufficient assets, then they will be punished with imprisonment for 3 years, "said the Muslim judge.

The decision on the replacement money was much lower than the prosecutor's demand for Rahardjo to pay Rp60.32 billion in replacement money.

The defendant Rahardjo Pratjihno himself was not present at the Corruption Court, but attended the trial from the KPK building via video conference . There is only the KPK prosecutor, a panel of judges and some legal advisers who hear in court.

The judge stated that Rahardjo and PT CMI Teknologi enjoyed a profit of Rp. 60.329 billion and also enriched other people, namely former special staff (resource persons) in the planning and finance sector of Bakamla Ali Fahmi alias Fahmi Habsyi of Rp. 3.5 billion.

PT CMI Teknologi is a company engaged in the business of procuring communication technology products and has been a partner (provider of goods / services) several times for government agencies.

Initially in March 2016, Rahardjo proposed to the then Head of Bakamla Arie Soedewo and Head of Marine Hazard Information Management (KPIML) Arief Meidyanto that Bakamla had its own (independent) backbone network connected to satellites in an effort to monitor maritime security or Backbone Surveillance integrated with BIIS.

Bakamla submitted a 2016 RAPB-P worth a total of IDR400 billion for the project procurement. Ali Fahmi then coordinated with parties in the National Development Planning Agency (Bappenas), the Directorate General of Budget and the Ministry of Finance before discussing the budget at Commission I of the DPR.

PT CMI Teknologi then came out as the winner of the auction for the procurement work "BCSS integrated with BIIS" Bakamla FY 2016 with a bid value of Rp397.006 billion. However, in October 2016, the Ministry of Finance only approved the BCSS budget of IDR 170.579 billion.

PT CMI Teknologi then subcontracted and purchased a number of goods, including the main work for 11 companies.

Until the deadline of December 31, 2016, Rahardjo was unable to complete the work, in fact there were a number of new tools that could be sent and installed in mid-2017.

However, PT CMI Teknologi was still paid in the amount of IDR 134,416 billion. From this amount, it turned out that the implementation costs were only Rp. 70,587 billion, so there was a difference of Rp. 63,829 billion as a profit from the backbone procurement at Bakamla.

The profit value is reduced by giving to Ali Fahmi alias Fahmi Habsyi of Rp. 3.5 billion so that Rahardjo, as the owner of PT CMI Teknologi, gets an additional wealth of Rp. 60.329 billion.

In the end, the backbone procurement carried out by PT CMI Teknologi could not be used according to the expected purpose because the quality of the system had not been functioning properly, as stated in the report on the results of a physical examination by the Surabaya Institute of Technology (ITS) Team of Experts on October 29, 2019 which stated that even though all the Bill of Material that has been promised in the contract can be fulfilled by the contractor, but functionally it cannot be demonstrated properly as planned.
