Workers Can Keep Submitting JHT Claims Even Though The Company They Work For Is Still In Arrears

JAKARTA - The Minister of Manpower Ida Fauziyah ensures that workers can still claim Old Age Security (JHT) even though there are arrears in contributions by the company. This is in accordance with the new rules issued by the Ministry of Manpower (Kemnaker).

In a virtual press conference in Jakarta, Thursday 28 April, the Minister of Manpower Ida said that his party had issued a new regulation of the Minister of Manpower Regulation Number 4 of 2022 concerning Procedures and Requirements for Payment of JHT Benefits as of 26 April 2022 as a revision of the Minister of Manpower Regulation Number 2 of 2022.

In addition to simplifying the requirements for JHT claims, there are also several new provisions regulated in the Permenaker. Starting from claiming benefits for contract workers and BPJS Employment participants in the non-wage recipient (BPU) category.

Payment of JHT benefits is also made no later than five working days after the submission and the requirements are received completely and correctly by BPJS Ketenagakerjaan.

"Workers can still claim JHT benefits even though there are arrears in payment of JHT contributions by employers. The arrears of contributions must be billed by BPJS Ketenagakerjaan to employers," said Ida.

"So the rights of workers or laborers on the benefits of this JHT will not be lost," he added.

The new rule also restores the provisions for JHT claims such as Permenaker Number 19 of 2015, with participants who resign or are laid off (PHK) can still take benefits without waiting for the age of 56 years.

In addition, the regulation also simplifies the requirements for JHT claims, such as simplifying the required documents and submitting claims that can be made online.
