JAKARTA - The Regional Regulation Formation Agency (Bapemperda) of the DKI Jakarta DPRD is currently studying the revision of the DKI Regional Regulation Number 10 of 2011 concerning the Implementation of Respect, Protection, and Fulfillment of the Rights of Persons with Disabilities.
Deputy Chairman of the Bapemperda of the DKI Jakarta DPRD, Dedi Supriyadi, revealed that one of the points that will be regulated in the revised regulation is the obligation for government and private offices to employ persons with disabilities.
Because this is an obligation, the DPRD will include an article regarding the imposition of sanctions when a violation occurs.
"To be more assertive, there must be a separate article that regulates sanctions, so that it is very strong to become a legal provision," said Dedi in his statement, Wednesday, April 27.
In Article 24 of the draft Regional Regulation concerning the Respect, Protection and Fulfillment of the Rights of Persons with Disabilities, it is stated that local government agencies and BUMD are required to employ at least 2 percent of persons with disabilities from the total number of employees or jobs. Then in Article 35 Paragraph 1, private companies are required to employ at least at least 1 percent of persons with disabilities of the total number of workers in the company.
Article 35 Paragraph 2 emphasizes that the Provincial Government (Pemprov) of DKI Jakarta is obliged to register workers with disabilities as referred to in Paragraph 1.
Furthermore, Dedi said that the revised regional regulation will also explicitly regulate the prohibition for the government and private sectors to lay off workers on the grounds of disability.
That way, people with disabilities will get the right to work to choose a new position that suits their disability condition. They also have the right to receive skills training according to their disability conditions and the right to receive training according to their new position.
"So, after becoming a worker, people with disabilities have the right to get a return to work program," said Dedi.
