Case Of Man Stealing Motorcycle For The Cost Of Returning To NTT Then Hitting Pole And Injured In Karangasem Bali Terminated By Prosecutor's Office

JAKARTA - The Attorney General's Office has approved the request for termination of prosecution based on restorative justice at the Karangasem District Attorney, Bali.

One of the case requests that were terminated based on restorative justice was the case file on behalf of the suspect Agustinus Rehi Mone alias Agus from the Karangasem District Attorney, Bali. He became a suspect under the suspicion of Article 362 of the Criminal Code regarding theft.

The theft occurred on Thursday, February 3, 2022. Suspect Agus saw the Supra DK 2356 FCF motorbike parked with the motorbike key still hanging.

The suspect then fled the motorbike at high speed. During his escape, the suspect hit a signpost on the side of the road, causing the suspect to fall.

For fear of being caught by residents, the suspect ran from his motorbike to Denpasar. Arriving at Shangyang Ambu, the suspect boarded a pickup.

On the way, the pickup driver became suspicious because the suspect was in pain due to his injuries. The pickup truck driver took the suspect to the Candi Dasa police post.

"The suspect's purpose of taking the motorcycle belonging to him is to sell it and the proceeds from the sale of the motorbike will be used by the suspect to pay for his return to his hometown in Sumba, East Nusa Tenggara, because the suspect's workplace has not paid the suspect's work wages because the construction process has stopped due to the COVID-19 pandemic. 19," said the Head of the AGO, Ketut Sumedana in a written statement, Wednesday, April 13.

There are also reasons for the termination of prosecution based on restorative justice, namely that the suspect has committed a crime for the first time; the threat of a fine or imprisonment of not more than 5 (five) years.

"A reconciliation has been carried out in which the suspect has apologized to the victim for his actions, and promised not to do it again, and the victim has forgiven the suspect's actions," Sumedana continued.

Furthermore, JAM-Pidum ordered the Head of the Karangasem District Attorney to issue a Decision on Termination of Prosecution (SKP2) Based on Restorative Justice, in accordance with Attorney General Regulation Number 15 of 2020 and JAM Pidum Circular Letter Number: 01/E/EJP/02/2022 dated 10 February 2022 concerning the Implementation of Termination of Prosecution Based on Restorative Justice as a manifestation of legal certainty.
