Supreme Court Releases Former OJK Boss Fakhri Hilmi Defendant Of Jiwasraya Corruption

JAKARTA - The former Head of the Capital Market Supervision Department 2A of the Financial Services Authority (OJK) Fakhri Hilmi was acquitted of the corruption case of PT Asuransi Jiwasraya (Persero). He was acquitted on the basis of an appeal from the Supreme Court which rejected all of the prosecutors' demands.

"Declaring that the defendant Fakhri Hilmi has not been proven legally and convincingly guilty of committing a criminal act as charged in the primary and subsidiary charges," said Supreme Court spokesman Andi Samsan Nganro in a written statement, Thursday, April 7.

This cassation decision is registered in number 1052 K/Pid.Sus/2022. Andi said the decision was approved by the Chairperson of the Desnayeti Council and the two Member Judges Soesilo and Agus Yunianto on March 31 last.

"Freeing the defendant Fakhri Hilmi therefore from all charges of the public prosecutor," he said.

In making the decision, there are differences of opinion among the cassation judges. Agus Yunianto assessed that Fakhri was proven guilty of corruption but lost his vote to two other judges.

Thus, Fakhri was declared free. In addition to being released, the judge also asked for the good name of the former OJK boss to be restored because he was not proven guilty.

"Restoring the defendant's rights in terms of ability, position and dignity and worth," said Andi.

For information, at the first instance court, Fakhri was found guilty of corruption and sentenced to 6 years in prison. He then filed an appeal to the DKI Jakarta High Court.

In its decision, PT DKI then sentenced him to 8 years in prison. Thus, Fakhri submitted further legal efforts to the Supreme Court.

The determination of the suspect Fakhri in the Jiwasraya case was carried out by the Attorney General's Office. He was charged with Article 2, subsidiary to Article 3 of Law 31 of 1999 as amended in Law 20 of 2001 concerning the Crime of Corruption.
