Good News For Binomo And Quotex Victims, LPSK Ready To Facilitate Restitution Assessment Of Compensation

JAKARTA - Victims of the Binomo and Quotex binary options cases should not hesitate to ask for protection from the Witness and Victim Protection Agency (LPSK). The reason is, LPSK has a restitution facility for loss assessment.

"The victims can apply for protection to the LPSK for an assessment of their losses", said LPSK Deputy Chairman, Achmadi, quoted by Antara on Sunday, March 13.

Achmadi stated that the perpetrator could return the loss to the victim through a restitution mechanism (compensation by the perpetrator). The perpetrator's assets confiscated by law enforcement officers can be used to pay compensation to the victim.

Previously, the Criminal Investigation Agency (Bareskrim) of the National Police had named Doni Salmanan and Indra Kenz as suspects on suspicion of several criminal acts, including money laundering (TPPU).

Based on the provisions of Article 7A of Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning the Protection of Witnesses and Victims, it is stated that victims of criminal acts are entitled to restitution.

LPSK has the authority, one of which is to assess compensation in granting restitution, as stated in Article 12A paragraph (1) letter j of Law Number 31 of 2014.

The law also states that money laundering is one of the crimes in certain cases that are a priority in LPSK.

"In essence, we hope that the assets resulting from the crimes committed by the perpetrators can be returned to the victims", said Achmadi.

He hopes the victims can immediately report to the police or LPSK. Furthermore, victims can apply for compensation through a restitution mechanism with supporting evidence and data.

Considering that the legal process has just started, according to Achmadi, the opportunity to return compensation to the victim is still wide open. However, the success or failure of the restitution mechanism will depend on the judge's decision later.

"We hope that investigators and prosecutors can include the victim's restitution application in the prosecution file", said Achmadi.

That way, he said, justice for victims can be realized through a restitution mechanism whose source of payment is obtained from the confiscation of the perpetrator's assets.
