KPK Encourages Anies To Issue Instructions For BUMD Governor To Implement Anti-Bribery Management System

JAKARTA - The Corruption Eradication Commission (KPK) encourages the DKI Jakarta Province Regional Owned Enterprises (BUMD) to implement an integrated corruption prevention program. Not only that, DKI Jakarta Governor Anies Baswedan was urged to issue instructions for the implementation of Anti-Bribery Management.

This was conveyed by the Anti-Corruption Director of the KPK Business Entity Aminudin in a coordination meeting to discuss strategic issues at the Regional Secretary Office (Sekda) of DKI Jakarta Province City Hall.

According to him, this step must be taken because 64 percent of the most corruption crimes handled by the anti-corruption commission are bribes.

"Essentially, the KPK has an interest in preventing corruption in various sectors, whether in the government sector or in the business sector," Aminudin said in a written statement, Tuesday, February 15.

In addition, to prevent bribery, a total improvement in the governance of 16 BUMD companies needs to be overseen by the KPK. Moreover, the capital investment originating from the DKI Jakarta APBD is large but the profits are not appropriate.

Furthermore, Aminudin also said that the implementation of Good Corporate Governance (GCG) was not optimal in BUMD. Likewise, the number of bribes to launch projects, the use of CSR funds which are full of gratuities, and the lack of fraud control and supervision.

He even mentioned the case of corruption in land acquisition involving one of the BUMDs of the DKI Jakarta Province which allegedly caused hundreds of billions of losses to the state. Thus, the KPK feels the need to be present in the business entity sector to prevent similar corruption crimes from happening again.

“This is only the end. If we examine it more deeply, I believe there are many gaps to make deviations and this means that there are many opportunities for improvement there. So this is not only a matter of governance and supervision but also the integrity of officials in BUMD," he said.

Furthermore, the KPK submitted several recommendations regarding the management of BUMD. First, BUMD and the ranks of the DKI Jakarta Provincial Government need to increase the element of prudence in the use of capital participation and the implementation of CSR.

Second, the Corruption Eradication Commission encourages the issuance of Governor's instructions requiring all BUMDs to develop regulations for implementing GCG and preventing corruption in a consistent manner.

“Thirdly, we also encourage the issuance of the Governor's instruction requiring all BUMD to implement an Anti-Bribery Management System. And fourth, independent and objective control and supervision needs to be optimized," he said. Responding to this, the DKI Jakarta Provincial Secretary Marullah Matali said that the anti-bribery system management had actually been implemented in BUMD. However, he felt that it was not enough so that KPK's directives were needed.

"This BUMD manages a fairly decent budget, almost Rp. 30 trillion and the scope of work is not only in DKI, some have gone to other provinces. Today we brought in representatives of the board of directors from 7 BUMDs out of a total of 16. Therefore, we ask for directions, input and information related to improving BUMD governance so that they do not deviate from the applicable format and norms, "he said on the same occasion.

Meanwhile, DKI Jakarta Provincial Inspector Syaefulloh Hidayat ensured that his party will pay more attention to BUMDs more closely and intensely because there are large projects handled by a number of BUMDs in 2022.

The projects include the Formula E racing event, the Jakarta International Stadium, and the revitalization of Taman Ismail Marzuki handled by Jakpro, the extension of the PAM Jaya contract.

"We noted that there are many things that need to be improved, such as Risk assessment, Risk Mitigation, APIP quality, LHKPN compliance and gratuities, GCG implementation, fraud prevention, settlement of public complaints, WBS implementation and anti-bribery management," said Syaefulloh.

"In addition to holding anti-corruption workshops for all BUMDs, everything we discussed earlier will be included in an action plan as a form of commitment to improve the system," he concluded.
