JAKARTA - Former Managing Director (Director) of Regional-Owned Enterprises (BUMD) for Sarana Jaya Development Yoory Corneles was charged with 6 years and 8 months in prison plus a fine of Rp.

The land for the Rp0 DP project is located in Munjul, East Jakarta, which cost the state Rp152.565 billion.

"Demanding that the panel of judges at the corruption court (Tipikor) declare that the defendant Yoory Corneles is proven legally and convincingly guilty of committing a criminal act of corruption jointly and continuously based on the primary indictment. Sentencing the defendant with imprisonment for 6 years and 8 months plus a fine of Rp. 1 billion, subsidiary to 6 months in prison," said KPK Public Prosecutor (JPU) Takdir Suhan, at the Jakarta Corruption Court (Tipikor), as reported by Antara, Thursday, February 10.

The claim is based on the first indictment of Article 2 paragraph (1) in conjunction with Article 18 of Law no. 31 of 1999 as amended by Law no. 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code in conjunction with Article 64 paragraph 1 of the Criminal Code.

There are aggravating things in Yoory's actions.

"The aggravating things are that the defendant's actions do not support the government's program to create a government that is free from corruption, collusion and nepotism. The defendant's actions harm state or regional finances, the defendant as the Director of BUMD who runs the DKI Jakarta Provincial Government program, so that the defendant's actions damage trust in the government. government agencies, especially the DKI Jakarta Provincial Government," said prosecutor Takdir.

As for mitigating matters, Yoory is considered to have never been convicted of another criminal act, admits and regrets his actions.

Yoory was also not charged with a substitute money sentence.

"During the trial process no evidence was found, where the defendant Yoory did not enjoy the state losses that were found. However, thus the defendant's actions have enriched the witnesses and PT Adonara Propertindo corporation, where the total amount is Rp. 152.5 billion, thus that the element of by committing acts of enriching oneself, or another person, or a corporation, it has been proven legally and convincingly according to the law," said the prosecutor.

This case began in the 2018-2020 period, the DKI Jakarta Provincial Government was looking for land for affordable housing for Low-Income Communities (MBR) through the Rp0 DP house program.

To realize this program, in 2018 Yoory Corneles as the President Director of Perumda Pembangunan Sarana Jaya (PPSJ), which is a Regional Owned Enterprise (BUMD) of the DKI Jakarta Provincial Government, submitted a proposal for Regional Capital Participation (PMD) to the Governor of DKI Jakarta for the 2019 FY APBD of Rp1, 803 trillion, with plans, among others, to purchase new production equipment, the "DP 0 Rupiah Residential" project, and the Tanah Abang Primary Center project.

Furthermore, a private company, namely PT Adonara Propertindo, is looking for land according to the criteria requested by Yoory, namely an area of more than 2 hectares, position on a major road, a width of 25 meters in front of a plot of land and a minimum "row" of about 12 meters.

In February 2019, PT Adonara Operations Manager Anton Adisaputro discovered land in Munjul, Pondok Ranggon, Cipayung, East Jakarta, covering an area of 41,921 square meters belonging to the Congregation of the Sisters of Carolus Boromeus (Congregation of the Sisters of CB).

The director of PT Adonara, Tommy Adrian, then reported the matter to the "beneficial owners" of PT Adonara, namely Anja Runtuwene and Rudy Hartono Iskandar, so it was agreed that Anja approached the Congregation for the CB Sisters.

Anja then met with representatives of the CB Sisters Congregation in Yogyakarta using religious affinity, so the CB Sisters Congregation agreed to sell the land in Pondok Ranggon with an area of 41,921 square meters at a price of IDR 2.5 million/sqm.

On March 29, 2019, an advance for land of IDR 5 billion was paid and PT Adonara transferred it to the account of the Congregation of the CB Sisters.

Yoory then met with Tommy Adrian to discuss the price of the land. Initially, Tommy asked for a price of Rp. 5.5 million/sqm, but in the end it was agreed that Rp. 5.2 million per sq.m. with the promise of a reward given to Yoory.

When a site survey was conducted, it was not possible to determine the boundaries of the land because there was no data or supporting documents for ownership and it was known that the location of the land was on a small road (the road row was less than 12 meters), but Yoory still ordered that the purchase process be continued.

Although the PMD request has not been disbursed, Yoory still ordered Yadi Robby to prepare a number of documents with a backward date regarding the payment of the first stage (50 percent) at a price of Rp5.2 million/sqm, even though the PPSJ Board of Directors meeting only approved a purchase price of Rp5 million/sqm .

In June 2019, the PPSJ investment team submitted a study that 73 percent of Munjul's land was in the recreation green zone, green lanes and road infrastructure, so development could not be carried out.

Yoory then used the services of the Public Appraisal Service Office (KJPP) Wahyono Adi to carry out the appraisal which was intentionally made "backdate" and submitted a report according to Yoory's request, which was Rp. 6.1 million/sqm.

On December 10, 2019, Sarana Jaya received a PMD disbursement of Rp. 350 billion, and on December 18, 2019 it received a disbursement of PMD phase II of Rp. 450 billion, so the total PMD obtained was Rp. 800 billion.

Yoory knew that Munjul's land could not be used for the "residential DP 0 rupiah" project, but still agreed to pay the remaining balance of Rp. 43.596 billion on 18 and 19 December 2019.

Because the deadline for repayment has ended in August 2019, but there has been no realization from Anja Runtuwene, on August 14, 2020, the Congregation of the CB Sisters requested that the Sale and Purchase Binding Agreement (PPJB) be canceled and requested that documents related to property rights be returned and returned an advance of Rp. 10 billion.

The total money received in Anja Runtuwene's account amounted to Rp. 152,565,440,000 and has been used by Anja and Rudy Hartono, among others, for the operational needs of the company PT Adonara Propertindo, transferred to PT RHYS Auto Gallery which is still in the same group as PT Adonara as well as for Anja's personal needs. Rudy like buying cars, apartments and credit cards.

Yoory will file a memorandum of defense (pleidoi) on February 17, 2022.
