Hate Speech Suspect Regarding Kalimantan Edy Mulyadi Threatened With 10 Years In Prison

JAKARTA - The Criminal Investigation Unit of the National Police has named Edy Mulyadi as a suspect in the alleged hate speech case regarding Kalimantan where the genie dumped their child. In this case, Edy Mulyadi was charged with multi-layered articles that carry a threat of 10 years in prison.

"The overall threat is 10 years," said Karo Penmas of the Public Relations Division of the National Police Brigadier General Ahmad Ramadhan to reporters, Monday, January 31.

Ramadhan detailed the articles that were suspected of Edy Mulyadi. Among other things, Article 45 a paragraph 2 in conjunction with 28 paragraph (2) of the Information and Electronic Transactions Law (ITE).

"(Related article, ed) any person who knowingly and without rights spreads information aimed at causing hatred or hostility to certain individuals and or groups of people based on ethnicity, religion, race and class (SARA)," said Ramadhan.

Investigators also suspect Edy Mulyadi with Article 14 paragraphs (1) and (2) of the Criminal Code in conjunction with Article 15 of Law Number 1 of 1946 regarding criminal law regulations, and Article 156 of the Criminal Code.

The determination of the suspect Edy Mulyadi was based on the results of the case title and a series of processes for examining witnesses and experts.

"After the case is carried out, the investigator has upgraded the status from witness to suspect," said Ramadhan.

In addition, investigators decided to make arrests after the social media activist was named a suspect.

"Against EM's brother (Edy Mulyadi) investigators made arrests and continued detention," said Ramadhan.

The detention of Edy Mulyadi for two reasons, namely objective and subjective investigators. For one thing, investigators were worried that Edy Mulyadi would destroy evidence.

"Subjective reasons are fear of escaping, fear of losing evidence, fear of repeating his actions, objective reasons of threat being imposed for more than 5 years," said Ramadhan.
