The DKI Provincial Government Must Face The Ministry Of Manpower Because It Is Desperate To Raise The UMP By 5.1 Percent

JAKARTA - The ranks of the DKI Provincial Government, especially the Manpower, Transmigration, and Energy Office (Disnakertransgi) have answered at length about the DKI DPRD's questioning the reason for the DKI Jakarta Governor Anies Baswedan to revise the increase in the 2022 UMP.

In a meeting at Commission B of the DKI DPRD yesterday, the DKI Provincial Government was adamant that it would not revise the provincial minimum wage which was revised from 0.85 percent to 5.1 percent.

Although, Anies and his subordinates are aware that the revision of the UMP is not in line with the regulations of the Ministry of Manpower (Kemenaker), where the formula for setting the UMP is based on Government Regulation (PP) Number 36 of 2021 which results in an increase of 0.85 percent.

"There is no possibility of further revision of the UMP 5.1 percent. The consideration is that we have taken everything into account. Once again, we have considered all of these things," said the Head of the Manpower and Transmigration Office on Monday, December 27.

Therefore, after giving an explanation to the DKI DPRD, Andri admitted that the DKI Provincial Government will then deal with the Ministry of Manpower to provide reasons for his party to increase the 2022 UMP by 5.1 perseb.

"In accordance with the direction of DPRD members, we will communicate to the Ministry of Manpower as well as to the Ministry of Home Affairs, explaining the reasons why we took this policy," said Andri.

Andri also knows that the central government will impose sanctions ranging from a warning to the dismissal of the governor from his position if he does not comply with the central decision in determining the increase in the UMP. However, Andri is still optimistic that the central government will understand if the DKI Provincial Government explains their reasons.

"God willing, I will continue to be kind, after intense discussions regarding the conditions of one region and another, it is not the same. This, God willing, becomes a very good understanding and can be used by all parties," he replied.

As is known, Anies changed the UMP increase from 0.85 percent to 5.1 percent. In 2021, DKI's UMP is IDR 4,416,186. If it increases by 0.85 percent or Rp. 37,749, the 2022 UMP will be Rp. 4,453,935. Then, when Anies raises 5.1 percent or Rp. 225,667, the UMP for DKI next year will be Rp. 4,641,854.

Instead of referring to PP 36/2021, Anies used three other legal bases in determining the revised UMP. First, Anies uses Law No. 29 of 2007 concerning the DKI Jakarta Government as the capital city of the Republic of Indonesia.

The second is Law Number 23 of 2014 concerning Regional Government which was amended several times in the Job Creation Law Number 11 of 2020.

The third is Law Number 30 of 2014 concerning Government Administration which is amended in the Law of Job Creation Number 11 of 2020
