WE Are Reminded To Be Constitutional, Not To Break The Law

JAKARTA - Criminal law expert from the University of Indonesia (UI) Indriyanto Seno Adji reminded the Coalition for Action to Save Indonesia (US) to act according to the constitution. OUR criticism to the government is reminded not to go too far in provoking it to break the rules.

Indriyanto said that if criticism of government policies was involved in accusations of Jokowi of violating the constitution and spreading provocation, the criticism or statement could potentially become a form of formal insult.

"So, it must be distinguished between criticism / statements in the context of freedom of opinion and formal insults that violate the law," said Indriyanto in a written statement to journalists, Tuesday, August 18 evening.

Indriyanto gave an example of criticism of 'going too far' which could potentially violate the law. Narratives that can be categorized as breaking the law are allegations without evidence against Jokowi, which can provoke many people.

Indriyanto quoted Prof. Eddy OS Hiariej's statement regarding the intention (Voornemen) and the initiation of implementation (Begin Van Uitvoering) which were already approaching the intended offense (Voluntas Reputabitur Pro Facto) were unconstitutional ways that wanted to fight against a legitimate government. So this is included in the fulfillment of the elements of treason offenses in Article 107 of the Criminal Code.

"WE should act constitutionally, because the statement of freedom of opinion politically is never absolute without limits, because in the life of a state, there are regulatory limitations and legal doctrine that provide an implementative political and legal fence. Do not let the signs be destroyed to violate the law, "said Indriyanto.

WE were declared at the Proclamation Monument, Jakarta, by Din Syamsuddin along with a number of figures including former TNI Commander Gatot Nurmantyo. Din Syamsuddin emphasized that WE was formed to help deal with national problems.

In front of the masses, Din Syamsuddin emphasized that WE were formed as a moral movement. This movement aspires to uphold the truth and create justice for society.
