DEPOK - Two child victims of sexual violence with the initials BA (14) and J (14) received restitution or replacement money from perpetrator Syahril Parlindungan Marbun at the Depok District Court, West Java.

In the verdict, the judge ordered Syahril to pay compensation of Rp11,520,639 to BA's victim. Meanwhile, victim J, Syahril, paid a fine of IDR 6,524,000.

The handover of the restitution or compensation was witnessed by the Head of the Depok District Attorney's Office (Kejari) Sri Kuncoro and the Head of the Depok Kejari General Crime Section, Arief Syafrianto, as well as the Deputy Chairperson of the Witness and Victim Protection Agency (LPSK) Antonius PS Wibowo.

In the Depok District Court's decision which was upheld by the Bandung High Court, in addition to being found guilty and sentenced to 15 years in prison and a fine of Rp. 200 million, subsidiary to three months in prison, the perpetrator was charged with paying restitution.

From that decision, the perpetrator had filed an appeal to the Supreme Court, but his application was rejected.

LPSK Deputy Chair Antonius explained that the fulfillment of the right to restitution was a long struggle from the victim, his attorney, the Depok Public Prosecutor's Office, and the LPSK.

"Hopefully this (success) will be an encouragement for handling cases in the future," he said, Monday, November 29. Throughout 2021, Antonius continued, LPSK has calculated restitution of around Rp. 6 billion for 170 victims.

From this calculation, he said, the percentage of effectiveness of restitution prosecution is around 70 percent in the first and second quarters.

Restitution payments to victims from perpetrators, he added, were still relatively low, namely four cases. The cases include cases of sexual violence in Bengkulu and Depok. The other two cases are criminal acts of trafficking in persons.

Antonius explained that the calculation of restitution carried out by LPSK is based on three components including compensation for loss of wealth or income, compensation for suffering directly related as a result of a crime, and compensation for medical and/or psychological treatment costs.

This, he said, is in accordance with the mandate of Law Number 31 of 2014 concerning the Protection of Witnesses and Victims and Government Regulation Number 43 of 2017 concerning the Implementation of Restitution for Children Who Become Victims of Crimes.

According to him, success in fighting for victims' rights to restitution cannot be separated from the synergy between the victims, their attorneys, the Depok Kejari, and LPSK.

Thus, Antonius hopes that the synergy that has been built can be continued in order to bring justice to the victims. As reported by Antara.
