Banprov Bribery, Former Deputy Chairman Of The West Java DPRD Ade Barkah Sentenced To 2 Years In Prison

BANDUNG - Former Deputy Chairman of the West Java DPRD, Ade Barkah, and West Java DPRD member Siti Aisyah were sentenced to 2 years in prison by the Bandung Corruption Court.

Both were found guilty of accepting bribes to facilitate provincial assistance (banprov) for projects in Indramayu Regency, West Java.

"To try, impose a prison sentence of two years and a fine of Rp. 100 million, if not paid, the sentence is imprisonment for three months," said the Chief Judge at the Bandung Corruption Court, quoted by Antara, Wednesday, November 3.

The panel of judges stated that the two defendants were legally proven guilty of committing a criminal act of corruption in accordance with the alternative indictment of Article 11 in conjunction with Article 18 of the Corruption Eradication Law in conjunction with Article 55 paragraph (1) to Article 64 paragraph (1) of the Criminal Code.

In addition to the prison sentence, the panel of judges also sentenced Ade Barkah to pay a replacement money which was the result of a bribe in the case amounting to Rp. 750 million.

If he cannot pay the money after the decision has permanent legal force, then Ade Barkah's property will be confiscated for auction. If the property does not meet this value, then an additional 6 months imprisonment is added.

Siti Aisyah was also sentenced by the judge to pay a replacement money of Rp600 million with conditions such as Ade Barkah. If the assets are not sufficient, then an additional 4 months imprisonment is added.

Both of them, said the judge, have a burdensome thing, namely not supporting the government in the corruption eradication program as people who work in state institutions.

"The mitigating thing is that the defendant showed a polite attitude during the trial, had never been convicted, and had family responsibilities," he said.
