There Is A Prohibition Of The Constitutional Court, 31 Deputy Ministers Still Multiple Positions As Commissioners Of SOEs

JAKARTA - The Constitutional Court (MK) has banned the deputy minister (wamen) from holding concurrent positions as commissioners. However, there are 31 deputy ministers who are still holding concurrent positions as commissioners of SOEs.

The prohibition of deputy ministers from holding concurrent positions as commissioners of state-owned companies is determined by the Constitutional Court through a decision number 128/PUU-XXIII/2025.

Most recently, the Extraordinary General Meeting of Shareholders (EGMS) of PT Telkom Indonesia (Persero) Tbk, which was held on Tuesday, September 16, again appointed three deputy ministers to occupy the position as commissioners.

The three deputy ministers are Deputy Minister of Communication and Digital Affairs (Komdigi) Angga Raka Prabowo; Deputy Minister of Agrarian and National Spatial Planning (ATR)/ Deputy Head of the National Land Agency (BPN), Ossy Dermawan; and Deputy Minister of Immigration and Corrections, Silmy Karim.

Silmy Karim has served as Commissioner of Telkom Indonesia since May 30, 2023. At that time, Silmy was still the Director General of Immigration at the Ministry of Law and Human Rights (HAM).

Meanwhile, Angga Raka and Ossy Dermawan were appointed as the President Commissioner (Komut) of Telkom Indonesia on May 27, 2025 and continues to this day.

On September 4, SOE Minister Erick Thohir responded to the Constitutional Court's decision. At that time, Erick was reluctant to talk much. However, he said that the appointment of state-owned company officials, including commissioners, was part of the transformation carried out by the Ministry of SOEs.

"We are transforming the management according to the meaning we are currently doing," said Erick at the DPR Building, Parliament Complex, Thursday, September 9.

When asked about the two-year period for the adjustment period, Erick only emphasized that the transformation of SOE management would be carried out in accordance with applicable regulations.

"We will carry out the management transformation after what we carry out," he said.
