Hoping That The Workers' THR Are Also Smooth As Obtained By The PNS, TNI And Polri

JAKARTA - The Coordinating Minister for the Economy Airlangga Hartarto ensures that all Civil Servants (PNS), members of the TNI and Polri will get the Hari Raya Allowance (THR) on D-10 Idulfitri 2021. It is hoped that the smoothness of the allowances for PNS, TNI and Polri will also be felt by the laborer.

The Ministry of Manpower (Kemenaker) has issued a regulation on the provision of religious THR, in which the allowance must be paid in full to workers or laborers no later than D-7 before the Eid Al-Fitr. If the company pays the THR late within the specified time limit, a fine will be imposed.

Minister of Manpower Ida Fauziyah revealed that until now, no employer has reported his inability to pay the 2021 religious THR for his workers in full.

As is known, last week the Ministry of Manpower issued a Circular (SE) number N / 6 / HK.04 / IV / 2021 concerning the Implementation of Religious THR Granting in 2021 for Workers / Laborers in Companies. This Circular Letter stipulates that employers are required to pay their employees' THR in full or not in installments no later than H-7 before this year's Eid.

However, the government provides concessions for entrepreneurs who are unable to pay the THR in full due to the impact of businesses that have not recovered due to COVID-19. Employers can report the condition of their company to the local Manpower Office. The allowance limit given D-1 before Religious Holidays.

"To this day, there are no companies that cannot afford it. Because complaints usually read in the second and third weeks and the deadline for paying the THR H-7. So employers or workers report on D-7," he said in a virtual press conference, Monday, 19 April.

Before reporting to the Ministry of Manpower, said Ida, entrepreneurs who are unable to pay the THR in full this year, must first have a dialogue with their workers, including as a family.

"The dialogue between employers and workers regarding disability is based on evidence of internal financial reports and the results of bipartite discussions. Reported at the local manpower office," he said.

Furthermore, Ida said, entrepreneurs who violate by not giving THR in full and on time in accordance with statutory regulations will receive administrative sanctions and fines.

The rules regarding sanctions are regulated in the Minister of Manpower Regulation (Permenaker) Number 6 of 2016 concerning Religious Holiday Allowances for Workers or Laborers in Companies. In this regulation, companies that are late in paying Religious THR are subject to a fine of 5 percent.

"Sanctions for late payment in accordance with statutory regulations will be subject to fines. These fines are used for the benefit of workers or laborers," he explained.

The Ministry of Manpower forms a complaint post

The Ministry of Manpower (Kemnaker) officially opened a post for implementing religious holiday allowances (THR) in 2021. The aim is to provide consultation services, monitor THR payment complaints services to coordinate the results of law enforcement with related agencies.

Ida Fauziyah said that the existence of the 2021 Religious THR Posko is a form of government facilitation so that workers or laborers' rights to get Religious THR can actually be paid according to existing regulations.

"As a follow-up, we will immediately issue a ministerial decision regarding the command for the implementation of the religious THR, which this year is different from last year. Because we involve our internals, all of our units will be involved to command the THR post in 2021," he said.

In its implementation, the THR 2021 Posko involves a Monitoring Team from elements of Workers / Labor Unions (SP / SB) and from elements of Employers' Organizations who sit in the membership of the National Wage Council. This monitoring team is tasked with monitoring the operation of the THR 2021 Posko, as well as providing advice and input to the Posko Team regarding the implementation of the THR 2021 Posko.

Ida said, if the THR has a problem, workers or laborers can come directly to Building B, 1st floor of the Ministry of Manpower on Jalan Jendral Gatot Subroto Kavling 51, South Jakarta. With conditions, you must use a mask and bring the results of the PCR Test and rapid antigen.

However, if they don't bring them, workers or laborers will be directed to take a free COVID-19 test in the space provided.

"We also provide it for free (a COVID test) for those who do not have a COVID certificate or not," he said.

In addition to reporting directly, workers or laborers can also report THR problems by visiting the kemnaker.go.id website. The method is:

This page has two terms, namely THR information and THR consultation and complaints.

2. Select the menu for consultation and THR complaints.

3. Then enter the help center service, then select the complaint service.

Keep in mind, to carry out consultations and complaints, workers or laborers must have a user login, by entering their KTP, cellphone number or email, and password. If you don't have it, you can register first.

However, workers or laborers can also file reports through the call center 1500 630. This THR 2021 postal service will take effect from April 20 to May 20, 2021 during working hours, starting from 08.00 WIB to 15.00 WIB.

Regional heads were asked to be firm

Minister Ida said THR 2021 Posko was not only formed at the center, but also in Provinces and Regencies / Cities throughout Indonesia. The establishment of THR posts at the central and regional levels was carried out so that the implementation of coordination was more effective.

Ida hopes that the THR Posko can run in accordance with the mechanisms and provisions of the legislation in an orderly and effective manner, and an agreement can be reached that can satisfy the parties. Especially for groups of workers or laborers and employers.

Furthermore, asking governors, regents and mayors not to hesitate to impose sanctions on businessmen who violate the implementation of the 2021 Religious THR, in accordance with the applicable laws and regulations.

"I ask the governor and mayor to take an active role in supervising and imposing sanctions on businessmen who commit violations," he said.
