ITDC Files 2nd PK In Hotel Land Dispute In Mandalika

JAKARTA - PT Indonesia Tourism Development (Persero)/Indonesia Tourism Development Corporation (ITDC), BUMN Managing Special Economic Zones (KEK Mandalika)/The Mandalika have submitted a PK above the PK (2nd PK) regarding the land dispute between ITDC and Umar. This 2nd PK was submitted after the PK Decision from the MA RI which granted Umar's PK request.

ITDC Vice President Legal and Risk Management Yudhistira Setiawan explained, on December 30, 2021, his party had submitted a 2nd PK on the PK Decision from the Indonesian Supreme Court which granted Umar's PK request. As for our legal considerations in submitting the 2nd PK in this case, because on the land that is the object of the dispute between ITDC and Umar, there are two court decisions which have permanent legal force (in kracht) which contradict each other.

Meanwhile, another reason is because ITDC also has new evidence (novum) that has never been examined in the trial of the case.

"Furthermore, regarding Umar's attorney's statement which essentially stated that because based on the PK Decision, Umar had the right to build anything on the Pullman Hotel land, ITDC in this case fully submitted to the ongoing legal process, especially the 2nd PK application process that had been submitted by ITDC. For this reason, we ask that all parties respect the ongoing legal process," said Yudhistira in a written statement, Thursday, February 10.

Apart from that, ITDC ensures that Hotel operations continue to run normally during the legal process.

The Mandalika has 16 km of beautiful coastline and is surrounded by green hills, and is one of the ten priority tourism destinations or 'New Bali' set by the government.

In 2017 The Mandalika officially operated as a Special Economic Zone (SEZ) and has since attracted US$1.3 billion in Real Estate Investment. Currently, The Mandalika is being built as a world-class tourism destination, with various international standard facilities and attractions, one of which is the Mandalika International Street Circuit, which will host the World Superbike and MotoGP world motorcycle racing events starting in 2021.
